      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Styx,

 

I might just do that, can't hurt, and if it brought you success it's worth a try.

 

Tomorrow will be 6 weeks from the day they received the Prelim complaint letter.

 

What I might do is bang off an email/letter tomorrow to them reminding them they have 2 weeks before the 8 week deadline strikes and I complain to the FOS.

 

I am sure it won't come to that thought...haha.

Following Dangler8's lead (we started around the same time) I phoned CRU today to see if I could find out anything. Wasn't as lucky as him in getting told an offer was on it's way. Which is odd considering we both started a few days apart. Anway....

 

Spoke to someone, who to be honest was not that helpful and was rhyming off the usual patter till they realised I had half an idea about what I was doing and talking about. They first of all said that the timescales because of the backlog is that offer letters are sent out 8 weeks after they send you the original acknowledgement letter(:cool: )...I mentioned the FOS guideline...she put me on hold...and came back to say that as a rough estimate I should be receiving an offer on the week starting 14th May..which would be 9 weeks from the day they received my original letter and 6 weeks from when they sent me the acknowledgement :confused:

 

In conclusion I am not much further in the know :p

Stick with it, they will pay basic charges in full. If necessary be prepared to phone the day before deadline. Im sure there is a mailing problem at CRU.

UPDATE : Received a letter this morning from RBS settling in full. Usual standard letter but settling for the full amount. A. WOO. HOO. :D :D :D !!!

 

Thanks to everybody for their help and especially T4FF, Dangler8 and Styx! A wee break while I move flat and then onwards to claim against my, now closed, RBS credit card and Barclaycard accounts:roll: !

hi there

 

couldnt help reading your posts can i ask for some advice? My court date is set for July 4th ill be home from my holidays early that morning im a bit worried as i go away on the 26th of june what do you think i should do should i contact my bank? At what point did the RBS settle with you ive never heard anything from them hope you can help by the way congrats on your latest coup

Morning all,

 

I have been reading with interest, on and off, for a while now about the full charges issue. Never really thought about doing it before as I didnt think the effort justified the amount I thought had been charged in total over the years.

 

However, out of interest I asked for the statments (ordered via telephone banking and received within a week - charged £5 :-)) to have a look see. Over 5 years since I opende the account I was charged £1330 in charges in total!

 

Going to send off my prelim letter, recorded delivery of course, detailing charges and asking for a refund Monday morning.

 

Looks like RBS seem to pay out after the LBA letter but we shall see. I shall keep you all updated!

Hi there I have been reading with interest your comments -as I am with RBS.. We have now received a letter from their solicitors 1. stating Defence and 2. Request for further information. Just wondered if you had got this far - as received anything like this yet? thanks June

Hi congrats - I am in the process with RBS and have just received a letter from their solititors - why stating 'Defence' and asking for further information. Did you have to go this far?? thanks June
