Lloyds TSB settled in full before hearing

 

Cap One offered full settlement and default removed.

Good luck with your Halifax claim. Whilst waiting for your statements to arrive, spend as much time as possible reading the threads in the Halifax forum - so you've some idea as to what to expect from them.

 

Halifax seem to be settling at different times, some after the LBA but some after court papers have been issued (dare I say that it seems to depend on who is looking at your claim ;) ).

 

I found Halifax generally OK to deal with. Have a read of my thread to see how I got on with them :D (Not sure how to do a link to it, but click on my name at the side of this post and it will take to you my threads).

 

Remember to stick to your timescales and you will get all of your money back.

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

Hi annmarie and steve --- at what stage have they given you the offer??

 

If the offer is in response to your prelim - send a part acceptance/LBA, stating you will pursue the remainder.

 

If the offer is in response to your LBA - you could try ringing them, stating that your next stage is court and ask them if they can up the offer. I did this and they upped from £1445 (their original offer) to what I was asking for of £2281. I did get a "slapped wrist" in the form of - "did I not realise it costs money to run the account when items are returned". I responded by saying yes I did appreciate that fact, but it did not cost £39 per transaction and that the interest alone would more than cover the costs incurred in running my account". That stumped them!!!!

 

Anyway, if you'd like to post a new thread of your own in the Halifax forum, we can all keep up to date with your progress.

Thanks everyone for your reply. I do keep reading but sometimes it gets confusing and ends up going round and round in your head. One step at a time as the saying goes. I will be back with the next episode as soon as I do or do not receive a reply from them to my SAR letter.

I have just been onto the halifax as I have not had my reply to my subject access request sent 1/2/07. Very nice chap told me they have 40 working days to deal with it from the time they receive the request. Can anyone confirm this is correct? I had calculated 40 days from the day I sent the letter and have obviously made a boo boo.
