Can anybody assist us, we wrote to Barclays requesting access to our account history on 24 November 2006, on 06 December 2006 we received a letter which returned our cheque of £10 saying they would supply the information on a complimentary basis within 10 days, but saying also that information stored on microfiche did not fall within provisions of the DPA.

We did not receive the promised information as they promised at all, we wrote back on the 14 December 2006, pointing out that we were entitled to all of the information as it had been declared a relevant filing system.

On 15 December 2006 we received a letter telling us that they could not trace our account, also a letter received on the 22 December saying the same thing.

We wrote back on the 05 January confirming our account number and informing them of two previous address, since then we have heard nothing at all from them.

We sent the LBA to them on the 20 February 2007 giving them the stautory seven day reply period, again nothing to date.

Our dilemma is that we live in France so which court should we send the form N1 to, would it be our old town address of Penrith.

We would be glad of any assistance people can offer a sthe 40 days is now long since expired.:?

Sadly it seems you have allowed them to dictate the action, when they sent back your check and you didn't send it back stating your insistence that they treat your SAR as it should be they have in effect bought themselves this extra time.

 

You need to serve them the SAR and send them the cheque the 40 days starts counting from the day they receive them. If they need confirmation of your id its best to send something with your SAR to avoid further delays.

 

From what you have said you don't have a claim or complaint against them that you or anyone else can do anything about. If you complain to the ICO they will ask when the SAR was served, when they find out they sent the cheque back and offered to provide them for free they wont be able to do anything I'm afraid.

 

DO the SAR and put it down to experience, you could of course try to complain to Barclaycard and the ICO regardless but it may take some time.

Are you advising to send the cheque back to Barclays Bank? Because am in the same boat

 

I sent an SAR on the 26 Feb and got a reply back today saying they will send copy statement in few weeks. They £10 cheque was attached.

yep, if you look in the abbey forum they were using this tactic to refute peoples SARs a while back. they used microfiche as part of the argument but the key issue was they sent the cheque back and said well send them for free.

 

this puts you completely on the back foot and unless you respond and insist on them treating it as a SAR they then have as long as they want to comply or not as the case may be. And you cant do anything about it.

Thanks to all who contibuted to this thread, I/we have learned a very salutory lesson that will not be forgotten, so we will start the whole episode again but this time a little wiser

DOnt worry you wont be the last and you are certainly not the first to be suckered by the banks.

 

You'll probably send them the SAr and the following day your statements will turn up.
