hiya i went in to my local halifax and asked for my staments they charged £5 and said would take 10days, i got them 7days later yay

but im now confused as i have been trying to work out what to put in my letter, it says to put charges and unathorised overdraft charges seprate but on my staments it just says charges as notified and dosent say if its just a charge or for the unathorised overdrafts, sorry but cant get my head round it all:? all of the charges in total comes to £1933

On the statements Halifax normally put them all as Charges as Notified. They are normally all lumped under this.

Good news is you can claim them all back.

  • Haha 1

12-03-07 Halifax Received £1800

05-06-07 Halifax II Small Claim Served for £2503

Capital One - Won £768

Halifax Credit Card - Won £756

When you fill out your spread sheet.

You just put charges as notified. Haliprats dont detail them, so you dont heve to.

Make you go over the statements at least twice as many can get missed first time round.

Nice amount to get back...:D

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

All in all, quite busy at the moment and enjoying every minute of it

You can try to call 01422 380880 it is phone number to switchboard - ask for customer relations or tell them straight that you need to talk to somebody about your data protection act request - that some of statements are missing - they will transfer you. You can find almost any number on this site

SAYNOTO0870.COM - Non-Geographical Alternative Telephone Numbers

it will convert all expensive nongeographical lines (0870..., 0845... etc) to geographical equivalents which is usually much more cheaper (5p per hour or even for free depending on your calling plan).

Wish you luck with your claim

i dont know wheather to send my first letter stateing on the charges i have already then when i get my new staments then ammend it as i want to get the ball rolling can u do this??

You can do all this. The first time it really really matters is when you go to court.

So, your prelim, LBA and MCOl can all have differing amounts. At MCOL is the first time it shows 8% interest with an accumlative interest of 0.0022% per day! And thats the first time your amount is set in stone!

Hi kcom

just to let you know. when you want claim back you can get interest on your money because you could not used it. And now the interesting part. You can get or 8% but only after your claim will go to court or you can get so called contractual rate but only if you put it in your first letter (prelim). Contractual rate is higher ( you can claim up to approx. 30% - depending how much Halifax charge for unauthorized overdraf).Sadly I have not time right now to explain everything properly but if you will use "search" button above (it is in blue bar between "New Posts" and "Quick Links" buttons) and use words "contractual rate" you will see loads of threads regarding this. Just read and decide. You can still send new prelim letter after you get all statements and ask for this money. A number of claimants got this even from court and it is going to bit increased what you will get. I missed it because I did not knew about it at time when I send my letters. But it is worth of try. Wish you luck

kcom,

Have a read of my thread:

http://www.consumeractiongroup.co.uk/forum/halifax-bank-bank-scotland/56689-survivor-halifax-new-claim.html

I started in Jauary with a phone call to request statements, and got the money in my account 1st March. I followed the advice from this site, and used the Template Library for all the letters that I sent. I filed N1 at my local court in Hull, as I wanted someone to check that I'd completed it correctly. Just remember - you're only claiming back your own money that has been taken from you unlawfully - if you ever have any problems, just shout up and there will be someone to answer/help. I'm now claiming back charges applied to the wife's account

My prelim letter is done now...and speradsheets..however, my eyes were going over last hour - so think I need a re-check fresh eye after a nice cuppa!!!

With a bit of luck of it will go tomorrow, and then my 14 days commences!!

Kcom - I telephoned - and it honestly was straight forward - they deducted the £5 per account out immediately and said I would receive within 7 to 10 days - and I rec'd them on the 7th day exactly - so give it a go!! It is worth a try, I used the normal 0845 no - not anyone specific at all.

So cannot complain at all - they were spot on - so far!!
