Hi All,

 

Call me blind if you wish, but is there a letter template for a ss. 77(1)/78(1) CCA request that anyone can point me in the direction of please? Can't see one for love nor money, and really want to hit MBNA with it.....

The Consumer Credit Act 1974: please refer to for your own reference.

 

 

77 Duty to give information to debtor under fixed -sum credit agreement

 

(1) The creditor under a regulated agreement for fixed-sum credit, within the prescribed period after receiving a request in writing to that effect from the debtor and payment of a fee of [£1], shall give the debtor a copy of the executed agreement (if any) and of any other document referred to in it, together with a statement signed by or on behalf of the creditor showing, according to the information to which it is practicable for him to refer,—

 

(a) the total sum paid under the agreement by the debtor;

 

(b) the total sum which has become payable under the agreement by the debtor but remains unpaid, and the various amounts comprised in that total sum, with the date when each became due

 

© the total sum which is to become payable under the agreement by the debtor, and the various amounts comprised in that total sum, with the date, or mode of determining the date, when each becomes due.

 

With regards to the section above can you please supply me with a complete list of transactions and charges relating to my account with your organisation. Alternatively, a complete set of statements for that period will be acceptable.

 

Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you.

 

If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.

 

I enclose the statutory fee of £1 (postal order serial no: xxxxxxxxxxxxxxx). You have 28 days in which to comply.

 

If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. So correct me if I am wrong here..

 

Just had a read through ss. 77 and 78 of the CCA 1974. If I read it right, you would issue a request under s77(1) to a company you have a loan with and under s78(1) to a credit card company?

 

Just want to make sure I hit MBNA with the right one for my cc account..

Hi.

 

I have recieved the loan Credit Contract. I have found that there is no reference to the total amount payable under the agreement. I have the total amount borrowed, Number of monthly payments, amount of monthly payments but NO mention at all of the total amount payable.

 

Is this inforceable? If not what is the next step. How do I contact the lender or is there a template letter to challange the legallity of the loan.

I am assuming that the above CCA letter is OK to send for Bank Accounts and to DCA's who hold the debt that has been passed to them>

CCA request is only relevant to credit agreements....if you are talking about a bank current account or similar there won't be a credit agreement and so CCA request isn't appropriate.

If a bank & DCA is chasing me for a debt relating to a bank account, is there any similar action (cca) that I can take?

Hi

 

Can you give us the background to this please with dates and approx amounts. Which bank is it and which DCA?

 

What is it we are trying to achieve please i.e. what is your desired outcome?
