      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just signed up for my credit report with Experian and to be honest not sure what, if any action should be taken now. From what I can see there are 2 credit cards that show as having 5 late payments made on each of the accounts, these are with Halifax and Morgan Stanley.

 

I took my first credit card out 6 years ago with Lloyds and since then I have swapped and transferred my balance from one card to another, sometimes closing the accounts after I have transferred out and sometimes leaving it open with a balance of nil.

 

However I am not sure if all the information with Experian is correct, one of the reasons why is that I still hold my Lloyds credit card although I have used it once or twice from transferring the original balance it doesn't appear to show on the report, also it only appears to show late/missed payments as far back as 36months.

 

Can anyone shed any light on this and whether it's worth chasing up on the 5 late payments as you can guarantee they will have charged me for them probably only £20-£25 a time though.

I have just received credit reports from Experian and Equifax. I believe these are the two main agencies. I suggest that you obtain a copy of your report from the other agency as well, as information may have been supplied to both.

 

If you read the template which is used for your initial claim, there is a section which asks for any record to removed from the file as part of your requirements.

 

I am currently in dispute with Citi Cards and the amount of the charges are greater than the amount I still owe them. Therefore I have argued that had I not been charged, the account would have been cleared a long time ago.

Recieved a call today from Abbey CC some call centre in India asking me why I paid my last bill £4 short, told them I hadn't got the statement to hand and assumed I'd over-estimated it when making the payment obviously not. Pd the £4 over the phone after asking them to do a security check and they told me I'd incurred £25 late payment fee. Told them in breach of OFT and being charged £25 was ridiculous over £4 short, they gave me another number to ring to discuss it.

 

Will ring them tommorrow to see if they can justify it.

I feel that all correspondence with any bank should be in writing so that you will have a record of it.

I would not contact them at all until you receive your statements and send them the initial claim leter. Make sure you include the latest charge.

No, unfortunately I don't have the facility to record calls. Haven't rang them yet still wondering if I may be better off requesting dpa request from them, just not sure if it'll be worth it, suppose I won't know until I have the information.

Unless you know how much they have taken in charges from your account, how are you going to claim it back? Send them a DPA request as advised in the templates section. The amount owed may shock you. If you don't find out, you'll never know.
