:oops: I believe my journey really starts here.

 

I have written my first letter to HSBC on 1 February 2007 requesting £3,264 in bank charges. No response, although they ensured me that a letter was sent on 14 February requesting the breakdown of the charges I am claiming. On 21 February I sent the 2nd letter with the brakdown which was again completely ignored. In both letters I have given them 14 days to give my money back. They have not complied and tomorrow is the day when I will finally file a claim online with MCOL.

 

I would like to share my experience with all and I will be writing step by step of the process so people can gain from the experience. Once I have filed my claim online I will give you further details.

 

PS - This is a business account, so it will be fun to know what is their approach on this one!!!

I am trully happy this morning I have just filed a cliam online against HSBC. UUFFF!!! I am nervous now, let's see how long it is going to take for them to cough up.

Hello everybody,

 

I have just looked online and my claim against HSBC still says ISSUED. How long does it take for them to acknoeldge the flipping thing? I am getting restless...I want it and I want it NOW!!! B******s...

 

Just to think that I still have a long way to wait....!!!

:? I have got a question I hope one of you experts in there can help me.

 

After filing my MCOL I have discovered I missed 18 charges of £28 on my claim of nearly £4K. Stupidity I know, but I had some statements missing and I just decided to ask my business relationship manager for them and I can see those charges which I have not included.

 

I know the answer will be NO, but I will try:

 

Can I amend my court claim to reflect those charges?

 

I just do not want to go about taking HSBC to court twice, otherwise they will definetely close our business account which will be a real disaster!

 

Please advise...:razz:

Ok, I have phone MCOL and asked what is the procedure to change the claim amount. They are going to send me a form which I need to fill and send it back to them with a £35 charge no later than 28 March.

 

I understand that this will delay the claim as it will be served again on HSBC when the form returns to the court and they will have another 14 days from the serving date to respond and acknowledge, is that right?

 

Can anyone tell me if they think it is worth doing that for another £800? Or shall I just leave it?

I have a few queries...

Form N244

 

Part A - I put my name, intend to apply for an order (a draft of which is attached) - I know I have to sttach a new spreadsheet, but is this referred as a draft??? that would allow me to alter my total amount claimed because I missed 18 charges of £28 plus interest for the amount of £581.54 making a new total for the claim of £4,388.61.

 

Part B - which box shall I tick???? maybe evidence in Part C in support of my application

 

Part C

 

I don't know really what to write....maybe

 

I have enclosed with this form a revised schedule of charges with calculated interest to support my application.

 

I would be very greatful if someone could have a look and tell me if it looks fine or I need anything else or write something different.

i can't get into the form - i think there's something stopping me from saving it because i'm at work.

 

my advice, ring the court and ask for advice - they're usually very helpful

Well, I have sent my form N244 to amend my claim on Friday and I have just phoned MCOL and they said that it will take 4 weeks for the judge to review the changes and then they will re-serve the claim against HSBC. Everything will start all over again then.... I think I have another 5-6 months to wait for I reckon....

 

Am I ever going to see this money.....???? I wonder.....:(
