      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Laura, OOOOHHHHHH ERRRRRR! Thanks for that - i bit the bullet and called!

 

Just spoken to a lovely man in customer relations! After me being soooo nice to him he checked my account number and said they had received my letter on the 2nd March (actually checked my records and Borehamwood signed for it on 27 Feb, shows you the backlog they have). This was actually the prelim. They received my LBA signed for on Tuesday this week which he didnt mention, obviously hadnt got to that one yet.

 

He more or less said i would be getting my charges back but because of the size of my claim (over 5K) they would obviously have to validate it. Fine by me. He did say that i needed to appreciate the backlog they had with everyone claiming, which i do, and that i should expect, purely his estimation about a months wait, but i will still be sticking to MY timescales. Lovely lovely man and i feel loads better now, was starting to get bit worried having heard diddly squat from 2 letters. Cheers everyone, getting excited (sort of) now!

Ohh, well done Jetspark!

 

In not so many words the guy I spoke to basically said Natwest are paying out but some claims require validating which takes bit longer whilst others don't.

 

He initially said mine might need validating as there is a rogue .48p which he assumed was added interest. I assured him it wasn't and that the first ever charge on my account was a partial charge for unarranged borrowing but once he looked on their system he said it didn't matter as its approved - wooohoooooooooo!

 

Let us know how you get on Jetspark and definately stick to your timeframes, my LBA will be sent on 20th if I've not had anything, despite his assurances!

My LBA was supposed to go on 20th March but I’ve been out of the country for the last week so slightly delayed in getting it out.

As I was assured by Alan at Borehamwood that I’d have their letter by tomorrow, I’ll see what arrives. If nothing, that LBA will be in their hands by Thursday!!

Oh absolutely!! Ihad every intention of sending the LBA on 20th but work sent me over to Ireland on Monday which put things on hold! It also meant I missed Whistleblower :o(

Whistleblower was great, but didnt really learn much we didnt already know about banks, apart from the true cost of what it actually costs them them to bounce cheque etc. etc. Was good to have it confirmed, sort of. But get that letter sent. Dont give them any longer than you have to. The longer you leave it, the longer till your cheque plops through the door. Get on the case Laura. All the best. Well well well - I got hom today to find a letter from Natwest, as promised, offering me the full amount.

 

The letter contained the usual "We think our charges are fair bla bla bla" but what good news!!!

 

Will send the acceptance letter tomorrow and hopefully should have the money pretty soon!

Thanks Nattie. After my phone call the other week, I was 60% hopeful but there was still the element of doubt! I was over the moon to see the envelope waiting for me once I'd got home!

Oh, trust me, i already have!! To be honest, a lot of them are quite negative about it, not about claiming back charges per se, just the hassle of having to do it.

 

My mum has been talking with the National Debt Line recently about huge debts she's been allowed to rack up (most due to consolidating other debts, undoubtedly caused by charges etc). Its been suggested she enter into a DMP but I'd love to get her to claim her charges back first. She's just got a new job which will help the situation a LOT but the total debt is around £40k which, at 50, is unlikely to be paid pack in her life time!! I'm sure she could get about £5k back in charges over the years!

 

Anyways, I'll keep going on at people, I guess once they know I've actually won, and in 22 days & 1 letter no less, I'm sure they'll think twice!!

Hi Jetspark,

 

Wel done for completing MCOL - to be honest, I was kinda looking forward to doing that bit (although not as much as getting the money back!!).

 

I got a letter from BoS today re my credit card charges I'd tried to claim informally via telephone - they've offered me what they consider 50% of the total charges applied to my account. Their offer is actually more than 50% of what I had calculated so they've dug a partial grave there! I'll be rejecting and claiming the full amount which I now understand to be higher than my initial claim :-D.
