      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Right. just about to do my AQ now as I have not received a big fat cheque yet. Am I right in thinking I type a copy of the DRAFT ORDER FOR DIRECTIONS and also in SECTION G type The Claimant respectfully suggests that directions may be made blah blah blah.....

 

When I have done this what happens next... Asm I said time is going so slowly. I think my postman thinks I am stalking him........

You wait for directions from the court. It may be the draft you've proposed or it may be something else.

Right AQ now gone off (recorded delivery of Course).. Does any one know how long things take now. Am I looking at weeks or months. I am getting so sad - I leap on the postie every morning to see if he has anything for me. Fungers crossed big cheque soon PLEASEEEEEEEEEEEEE.

I have been waiting nearly 6 weeks now since the court received my AQ. I was told that the courts are swamped with claims at present. So it may be the long game. Sorry. easter.gif

Not far away from your beloved Cheque now Sif. Talking weeks I think rather than months. Im still waiting for defence back from Cobblers, then AQ. Parkvale warns me it could be a while yet, his claim is taking yonks beyond yonks. But were all right behind you. Best of Luck. But as well all know. You wont need it. Ooooh right where shall we all start on this one. Nothing really that new about banks last night I thought, other than a very very nice Yorkshire bank cost analysis lady who works on specifically analysing what everything costs in the bank, who agreed (anonymously of course) that it doesnt cost any more to bounce a cheque or direct debit, etc. etc. etc. than 2 quid. Can you flippin believe it. Here was me thinking Oh well, I dont like it, but I could imagine anything up to a fiver, but hecky thumpeth,, I was blown away when she said NO MORE THAN TWO QUID. OMG. How poopy the banks are. Theyre just common day not nice peeps who do not nice things, the way I see, and I stress here MODS before you wipe my statement for slander, this is my opinion only, not the forums. Phew, got that one out of the way, I think Im allowed, freedom of speech wise, to say that so long as I stress, IT IS MY OPINION, and not that of the CAG. (nope, Ive been gagged, and edited in red, so I changed it myself) lol......But we all know different, LOL. So back from dog walk, tea in hand, just had toast, and ready to get reading up cos postie doesnt come till around 12 so dunno yet if I received full defence from Cobblers yet. Yeah, and the fact that fraud is so easy to get away with on the inside of bank. I have to say,, Im really not that surprised. My idea on all this. Hum, always keep the barest minimum of money in your current account, i.e. to cover all your bills, but any left overs always put in a seperate savings account which isnt accesible online anywhere, you know, you remember good old fashioned building society passbooks. I got one of them still with Britannia. Doesnt pay much interest, but it works for me and I know its safe cos nobody can access it online. Ha. Account thieves wont bother us if we dont have much in, in the first place. Ha. You just try and get me you poopy bank peeps working in banks. (in the minority I know but they do exist, we now know).
