:| Hi all, I was refunded some charges from capital one, however they did say that they would refund me the difference and I would still be charged the normal £12.

 

My question now is, shall I leave it at this point or shall I continue for the rest (can I?), I do however feel this is fair and they were very polite in their letter, unlike the devious shabbey...

ingleby,the £12 is widely misinterpreted. The OFT actually said that “…the card issuer may only recover the relevant limited administrative costs arising out of those defaults”; that £12 is the “simple monetary threshold for intervention by the OFT.”; and that “Our assumption will be that credit card default charges set above this level are unfair unless there are exceptional factors.” In other words, the principle of them having to show that their default charges are consistent with the costs associated with a breach still holds. I'm not following the credit card threads, but I assume many people are pressing on for full recompense. Regards, Mad Nick
