Hi All

 

New to this site.:-)

 

My Story so far.

 

request statements Dec 06

1st letter sent Jan requsting £1255 plus Interest

letter received offering £600 declined.

2nd letter sent - no reply phoned them no joy!

Filed on line claim yesterday!!!!!

Any advice or indications on what might happen would be helpful

Did you file with MCOL?

what will happen now is the deadline for Barclays to enter their defence will come and go and you will think heyyy Ive won by default.

NOT!

Barclays seem to be able to enter their plea after the deadline so dont get your hopes up, they WILL defend..

But dont get disheartened, this doesnt particularly mean they will face you in court.

in this game you have to be patient and stay calm.

any problems there are loads of excellent users on here willing to offer their assistance,

Think I have made a mistake on my on line claim. have claimed back to 22/11/2000 which is over 6 years isthis going to affect my claim???

do what Barclays do.

State that 'as a goodwill gesture' you will not be pursuing the extra charges pre 6yrs. LOL

 

Just amend the SOC and send a copy to Barclays and a copy to MCOL for their files, with a covering letter stating the adjustment.

ermmmmm.

1. SOC = Schedule of Charges [spreadsheet]

 

2. The claim starts as soon as you decide to take action

a) you are claiming from the date of the first charge imposed

b) you are requesting your charges to be repaid

3) you commence court action by regeristing with MCOL

4) Action is transferred to court hearings from 28 days after issue to bank or upon receipt of their intentions to defend.

Hi thnks for your reply DarN3.

 

I have just been reading a post from Welshman (?)

 

He states once MCOL is submitted a list of charges should be sent to Barclays Legal and Compliance and MCOL Northampton County Court is this correct?

 

And Shall I amend my Charges so they are not over the 6 years

You can claim back more than 6 years on the basis that it has only just come to your attention that the charges were unlawful. Based on the fact that the bank had concealed from you the purpose and scope of the Penalty Charge

Yes read many other posts and still reading. Just a bit nervous about it all. So shall I amend my SOC by post to courts??

 

Just leave it if you are happy to try for more than 6 years. As i am just starting my claim i am not the best qualified to help you with the process for changing a claim.

 

I am sure someone on here can give you some sound advice.

Hi All

 

Had letter from courts this morning saying that Barclays are going to defend whole claim this was signed 8/3/2007. Very quick for Barclays as they usually wait to the last minute. Next will I get AQ from courts?????

UPDATE!

 

I have a court date for 20/7 and I have just rang Barclays and they said happy to settle out of court! Got straight through can't believe it! I have had to email details! Watch this spaceX
