you may as well wait for the AQ because they will defend.

Hi Dickeggsy

It was the AQ Barclays was suppose to file by the 15th March Judge extended the deadline to 27th March and now I am wondering whether I should call the court or just wait to see if the court will contact me? If Barclays did not file their AQ I'm right in thinking that I could file judgement against them by default.

Quick update. Called the court to find out if Barclays had filed their AQ (which they had) was informed that the district judge would be looking at the file today and I should hear back within the next week. More reading to do now with regard to the next stage. Any pointers for what I should be reading next?

I think if you've used the 'new' allocation questionnaire strategy there's not much to do really, just wait and see what the judge decides. If you're really bored you can read all the statutes and case law in the bundle :)

If in doubt read the

FAQs

If still in doubt - ask!

Thanks Advoc8 will just sit back and wait.

I have read somewhere on this site (which I didn't subscribe to silly me) that you might be able to claim back admin fees of £25 per hour upto 30 hours, plus a photcopying fee of £30 for the 3 court bundles Does anyone know if this is correct or have a link to a thread which has the info I'm looking for?

Err, sounds wrong to me. Litigants in person can claim some expenses (£9.25 per hour) but in the small claims track you'll only get them if the judge decides you're entitled to them because of the unreasonable behaviour of the defendant.

If in doubt read the

  • 3 weeks later...

Wow what a couple of weeks 3rd April was a passenger in my pals car which was in a road traffic accident (suffered servere concussion, whiplash and a trapped nerve in my shoulder).

Ten days later the shop that I work in part time was robbed while I was the only staff member on duty (now suffering panic attacks). Bad luck to me as that was Friday 13th.

There is a saying that bad luck comes in three's what's my third gonna be :| as I still haven't heard from the court and the deadline came and went nearly a month ago starting to wonder that the closer we get to the 23rd April the more likely this claim will be the third.

So anyway after my eventful couple of weeks I now have

1 x court case (claimant)

1 x court case (defendant)

1 x personal injury claim

maybe compensation claim aginst my employers for the robbery (looking into where I stand loss of earnings etc)

Also about to exchange contracts on house purchase

All I can say looking at that list written down is god help me.

Hey stevemcc

Nice to hear from a fellow claimant. Be patient you will hear back although I am starting to wonder whether I will ever hear back about this claim (Not complaining to much though as I have a mountain of other things to be getting on with) Have called the court a couple of times to see what is happening. Although court staff very helpful I keep getting fobbed of with the district judge will be looking at the file and I will hear in a couple of days. I have read on other threads that it can take 4 - 5 weeks to hear back (I am now at week 4). Do you have your own thread if so drop me a link it will be nice to keep up with what is happening on your case. :)

Regards

Ok Guys

I have finally got a date after waiting for weeks and weeks 13th July 07 10am at Barnet County Court.

Bricking it is not the word as sods law would have it, it's a Friday. Given all the reports in the press about the dude losing his case yesterday I'm starting to get a really bad feeling about this.

Is there anything I should be doing apart from getting my court bundle ready and is anyone else scheduled to attend court on this day as it would be nice to know that I won't be alone.

Is it worth me contacting Barclays now that I have a date to see if they will settle?

Any help or thoughts would be most appreciated.

hiya volks , try not to worry too much about the court thing (easier said than done i know) as far as i am aware it's not the same as a normal court , you know juries etc , just you the judge and their representative , if they turn up.

the guy who lost his case is a one off , there must have been something wrong with the way he presented his case because the same judge has settled other claims in favour of the claimant.

also if people use the new draft order for directions the banks must produce a court bundle by a certain date , if they don't the judge may award a judgement as in my case.

good luck.

thanks dickeggsy for the advice. I did use draft order for directions. Kinda hoping it's not gonna get that far. I'm sure I read somewhere on this site that their is a buddy system does anyone know if this is true and have a link to find out more. Feeling a bit superstitious with my date being Friday 13th and with my recent luck on Friday 13th don't think I really want to go it alone. Is there anyone in Barnet County Court on this date?

Hi Volks,

Dar£n or Martin3030 may be worth trying for the right T&C's.

Maybe you could speak to Barclays Litigation next week as you'll then be within a month of the Court hearing. Might they settle before you have to d/w Bundles.

Good luck, Slick

thanks for making me feel better I think the word your looking for is either

paraskavedekatria phobia or friggatriskaideka phobia meaning a fear of Friday 13th.

Read back through my other threads to see what happened to me on the last Friday 13th.
