    • If you visited Qatar you could be detained at the border, if the debt has been notified.  If you are only in transit and do not seek to cross border into Qatar you might be ok, but you may want to seek formal advice about this.
    • Howdy, I had a short lived credit card with Vanquis that I did not need. I paid it off in full and called them and closed it with the person at the other end. 2 months later they started sending me messages about late payments, I called them and to find out that the card had not been closed in error and 6 weeks after it should have been closed they paid a google debit of £560. I hit the roof and made a formal complaint that took them well over a month to respond to. They agreed they were at fault, refunded all late payments fees and offered me £100 in compensation. However they said the debit amount stood as 'I had benefit from it' and I should get a refund from google. I hit the roof again but they have stuck to their guns. The debit from google is a genuine one but I wanted to dispute it with google so closed the card so they would have to engage with me. But surely that's neither here nor there surely? What is the next step? Ombudsman takes forever doesn't it?  thanks in advance
    • Yes, it struck me this morning that I'd got it wrong    - no involvement of UKPPO in any previous Tesco thread    - there would have been an entrance sign to a Tesco car park    - CCTV isn't something associated with Tesco car parks. Presumably whoever runs the car park has put CCTV at the electric, and probably BB, areas, done absolutely nothing to stop abuse, and then rubs their hands in glee every time the CCTV catches a motorist out. You can pay £60 and this will go away. Or you can defy UKPPO and rely on their non-respect of POFA, consideration period, etc., should they be daft enough to do court later down the line.  We would support you all the way.
    • Good evening folks, i have my hearing tomorrow at 3pm. I have never been to court for a civil matter, what is likely to happen  and what do i need to do?  I plan on going straight from work, i finish at 2pm, it will take about half an hour to get there, does that sound ok? I called the court late this afternoon, sadly i was too late in the day and the office was closed.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Has anyone else replied yet along these lines? I really am quite concious of being careful at this stage because I don't want to trip up and jeopardise my claim.

 

 

 

You know what. I have just finished working for Halifax Bank of Scotland and I can tell you for certain that most of their admin departments are run by (edit). I am starting to think that cobbets are the same. :D

Folks

 

Been away for a couple of days. Still a bit unsure about how to respond to Cobbits. Has anyone who received the same letter sent back a reply yet? I can feel the end drawing close. Any advice would be most helpful

Have seen that exact letter twice and each time Cobbetts offered full settlements the very next day. Although they were slightly dfferent to yourself as default judgement had been passed and set aside hearings had been allocated. The end is indeed drawing close...and so is your full settlement.

Hi all,

 

I am at exactly the same stage as you guys, I recieved the "bumph" from Cobbetts and the corts on Friday and I have snet a letter to Cobbetts giving them my Accounts details and responded to the CPR 18 request. (I have copied a letter someone else has posted on here)

 

Anyway, I am going to send this of now and see what happens.

Hi Robert, take a look at rbrears posting on the General forum re section 18 and claim particulars. He had a similar experience and was successful.

Hmmm Interesting link.

 

I sent my letter yesterday (the one on the thread above this somewhere) but if they come back needing more then I will rip that Particulars of Claim letter out and throw it back at them. At this stage they are merely kicking back (as it looks like they do with everyone).

 

Sad isn't it.

A question about couert.

 

I have sent my allocation questionnaire back to York CC already and yesterday I sent this letter:

 

Can you simply send supplementary evidence into the court once you have sent your AQ through? Is it a case of simply drafting up a letter with the claim number and details on saying something like 'Supplemntary to my claim, here is balhg blah blah"?

 

In addition, do you think it is worth sending the court all of the letters that I have received from Cobbetts?

 

To be honest (and i touch wood when i say this), They must be absolutely inundated with these claims at the moment. If sooooo many have been settled, it is difficult trying to guage NatWest's relatinship with Cobbetts. I must simply be that the only defence is scare tactics and stalling. You can almost imagine Natwest saying to Cobbetts "Just do your best lads, the more you faff about the more likely they are to drop out of the claim".

Hi,

If this did actually get to court I can say the judge would not be happy about them stalling on the no account details issue. I don't know why they are trying this as it's an issue you can't lose on. The judge would say something along the lines of it's on the relevent paperwork, and the issue would end. Very strange.

Gosh you lot must think that I am insane posting messages continuously to myself.

 

Anyhow - I have made a slight alteration to my tactic. Having spoken DIRECTLY to Cobbetts I have come to the following conclusions. This is for people in the same situation as me.

 

When Cobbetts send you the letter saying that your Particulars of Claim are insufficent, don't just send one back saying 'Yes they are'. Have a look at rbears claim as he wrote a blinding reply to them. Either nick bits out of his, reword or rewrite but if you choose to do so (at your own risk) make sure to make any changes you deem necessary, obviously making sure you put your own details in! There is link to this thread somewhere above. Note that he had to ask the courts permisson to send this but in my opinion, you are simply replying to a request from Cobbetts anyway so I don't actually think this necessary unless you sent your own particulars beforehand.

 

Have a look at the counter-request for information. This is both legitimate and very bloody clever if you ask me, you are smashing the ball back into their court and to be honest, they are on their back foot anyway (gosh - Wimbledon really has sunk in).

 

I don't think it is advisable to simply rely on the idea that many people have won so therefore so should you.

Ditto, I got exactly the same responses from Mr Higley. They have until Friday and then I will be logging my claim through MoneyClaim too!! Not like I can afford it, but you have to speculate to accumulate!

 

Check whether or not you are entitled to a fee exemption.

 

If not you can apply to the court for a remission. It costs nothing to try.

Hmmm I am actually well past this stage but thanks for the advice anyway. I am literally just sitting here waiting having sent my AQ off, and the requested particulars of claim document to Cobbetts in Manchester.

 

How god damn long does this take!??? NatWest (Cobbetts) are taking forever to sort this out and it is DOING MY HEAD IN!!!!!!!!!!!!!!!!

The allocation questionnaire is the form that you send to the county court stating that you want to pursue the claim through the court. Cobbetts have an allocation questionnaire for their defence which they send once having taken into consideration the particulars of your claim etc.

 

I am floating in Limbo at the moment though and awaiting either a full settlement from Cobbets or a letter from the Court.

 

And I am in need of the money! I followed the same course as Rbears and pretty much plagerised his letters to Cobbetts, who according to the threads on Rbears' Natwest claim, folded shortly afterwards.
