Hi guys.

First of all what a great site, the advice on here is great and it helps to see other people in the same situation as your self.

 

I have just recieved statements from abbey as requested under the DPA, but i only recieved the last 11 months. No letter of explanation with them and also they were sent with no charge.

 

I have read about abbey and the microfiche saga so have sent the letter telling them that they have seven days left to comply with my dpa request.

 

Did anyone recieve the info requested within the 40 days.

I sent Abbey the same letter, and they only sent me the last 11 months of the requested statements. About two weeks later I then (without sending any further letters) received all of the requested statements which im now going through to check the total amount they owe! good luck.....!

Keep us updated on this, we can offer further advice if they do fail to meet the DPA request in time.

I have been wondering what people are doing about this 11 month statement issue that seems to be popping up in this forum. Abbey seem to be sending the money back when sending the 11 months of statements back. I have not investigated it yet but I'm assuming 11 months is not chargeable, they are sending the money back so the DPA form is not what has caused them to issue the satements. therefor giving them another 40 days to comply once you send it back to them, if you send it back to them, hope you lot get my drift. By the way thanks for this forum. I will look into this issue in more detail. I think the people who received their check back with only 11 months need to resend the DPA letter and the money. no one gives money back fro nothing especially a bank.

Welcome to the forums poeticj, but please don't sidetrack threads like this - by all means do start an entirely new one though...

No, they are trying their best to wriggle out of their duty as early as possible, and I think they see this issue as a way out.

Complaining to the IC if they do not respond satisfactorily is the answer.

...and/or sue them for non-complience with the DPA - as at least 2 others on here are doing.

 

They'll soon get the message that we will not be messed with.

I have still only recieved my 11 months worth of statements. In my letter I authorised them to take the money from my account as one of their advisors in the branch said this was ok. They told me it would still be cleared as a DPA request as authority to take money was enough to start things off (this was the case with my two other claims also - they just debited from my account). I have £400 + charges in my account in last 11 months. In response to my DPA reminder letter I just got a standard reply telling me they will respond within 4 weeks.

 

Should I (a) Start to dispute the charges I know about and wait for the statements from previous five years to arrive.

 

(b) Start to dispute charges I know about and then send off a new DPA request with the cheque and a complaint about mis information from their staff (why does this not surprise me!!)

 

© Wait until I have all staements to dispute charges.

 

hope some one has some advice for me

the 40 days would be up 25/05

Wait for the 40 day deadline, and then we can move it on from there, depending how you want to proceed at that stage (as per above posts)

Well I have still not recieved anything other than the last 11 months statements. The dealine is up tomorrow. I have had a letter today explaining the microfiche issue and saying that my statements would be forwarded to me in due course.

 

Unless due course is tomorrow then they have breached the 40 day rule!!!

"In due course" seems to mean a very long time indeed. I first asked for transaction information in early February and they're said to me only this week that it would be provided "in due course".

 

Whatever you do,stick to your timetable. Otherwise you will end up in Abbey's swamp of delays, excuses and prevarication.

Good luck with the abbey claim i'm still waiting for statements they are never going to come so i have to proceed with an estimated claim.

Abbey-received DPA letter on 13/03, received some breakdown till 2004 waiting for the more recent ones(where most charges occurred)

sent reminder email on 17/4/06

called abbey on 19/04/06 to remind them:rolleyes:

sent another email on 26/04/06:mad:

Approx charges £2500

received £500 refund in dec 06

sent LBA

Capital one- sent DPA letter 17/03

Sent prim letter for charges of £260 14/04

Received a refund £109 awaiting further refund of £151

Settled IN FULL

Barclay card- Sent DPA letter 17/03 sent reminder 14/04

received info claiming £120

settled in FULL

Have a look at Alanfromderby's thread about his DPA claim. You may be better off making a claim through the courts for DPA disclosure and setting out a timetable for an estimated claim rather than going straight in with an estimate.

 

Alan and I are both going down this path. It really doesn't give Abbey any option but to either stand and fight on very dangerous ground for them or cave in. It also helps to offset the slightly higher risks of an estimated claim.

I'm also in the same aboat as you skint chick i have been advised to send the letter before action failed dpa request, i'm sending it today recorded delivery, i'd suggest you'd do the same.

I think I will, is there a template for the letter, I have had a look but couldn't find it. Having said that I do have a three year old and a one year old tearing round my living room at the mo. How did you make your estimate?
