    • The sign says "Parking conditions apply 24/7". Mind you, that's after a huge wall of text. The whole thing is massively confusing.  Goodness knows what you're meant to do if you spend only a fiver in Iceland or you stay a few minutes over the hour there.
    • Hi and thanks It looks like they ticked all the boxes to me but I'll try and upload the notice. I was wondering if a witness to late delivery might be considered proof - I'm assuming they posted it as normal but Royal Mail stuffed up delivery. If not then they're really saying it just has to be posted within 12 days of the incident, regardless of when it is received.     • ROFL - dont get upset just because someone (quite a lot of someones) dont want smart meters - well unless you get paid for it .. in which case ...   I assume you haven't been with Octopus long enough to be on one of the very long fixed price tariffs they offered before the prices went bonkers .. and that you dont use your electricity in the evening/lunch time if you think the 'agile type tariffs are good value .. let alone worth installing a smart meter for - high price a good disincentive for an evening cuppa eh? Let alone all your computer/tv etc time in the peak price evening or lunch time. - and boy do those peak prices instantly hammer your bill when those Russian and middle eastern issues kick off.   I would only have considered a smart meter if solar panels had been an option for me - but roof is oriented completely the wrong way. Oh - and My opinion hasn't changed since the smart meter trials 40 years ago, because neither have the issues (well not enough) but I'm happy for you. Be happy for me.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All, Back from a lovely break :-). Just flicking through the paperwork and relaised that the court issue the claim on the 30/03/07 (oh by the way I sent in the schedule of charges with covering letter and a calculation of the interest) and it says they have 14 days to defend. is that working days? if so that means they have until the 13th and up until now they havent defended. Anyone have any idea's?

hiya hun welcome back glad u had a great hol

 

mine have until tomorrow (midnight) to acknowledge havent heard anything as yet, hoping they have forgotten but i doubt it.

 

14 days is working days and weekends hun, did u recieve a notice of issue from the court, it will give a date on there when they have till.

 

i got my fingers crossed for u hun,

the court papares say they have until the 18th April to defend and nothing yet so we will see.

 

I sent further info to the court (schedule of charges & interest)is that all I have to do up to now?

nope not heard anything as yet, they have until today to acknowledge the claim, and they havent done so as yet, i have to give them until midnight tho, so when i get to work tomorrow ill check and see if they have, and if not then il file for judgement.

They acknowledged the claim, can you tell me whether its 28 days to enter a defence from acknowledgement or from issue....?

ur only a few days behind me hun, i got my fingers crossed for u

 

mine have until wednesday 25th to file a defence but i know they will on that day, im hoping i wont have to do an aq that will speed it up a bit then

They have until the 02.05.07 to file defence and they have intended to so lets see what happens....! Been reading alot of threads that they they are doing away with the AQ suppose this makes it slightly easier for us then....?

yeh hun they will either file on that day or the morning of the next like they did with me the gits lol

 

im hoping i wont get an aq as cant afford the £100 at the mo, ive been told it takes at least 1 month wait off so heres hoping

 

im keeping an eye on urs hun and got my fingers crossed for u

they will either sometime later today or tomorrow morning but they will do it hun. i got my fingers crossed for u that they wont, but even if they dont the court will allow them a bit longer to do so, they defended mine but not had their defence yet, hoping it arrives soon i want a court date lol

Checked this morning and they defended as we knew they would, just keep thinking I am one step closer to getting my pennies back :-).

 

All to do now is wait for a court date :-)

Hey all,

 

Just a quick update. got a letter saying that the matter had now been transferred to my local court (Dartford) along with a copy of their defence which from a bit of research on here looks really standard. I dont need to do an AQ it says, assuming I just wait for a date now...?

yep im at the same stage as u been passed to local court and aq dispensed with, its been 2 weeks on thursday that it was sent to mine tho, so hopefully wont have to wait much longer, just want that court date. im keeping my fingers crossed for u

I was originally told I didn't need to do an AQ then a couple of weeks later I received one from the local court. I sent that back by the due date of 11th May and haven't heard anything since.

From the little that I know about claiming,even though I have a claim against The Woolwich myself.People have been advised to send a draft order to the court and the bank requesting a breakdown of the true costs that the bank incurs when charging the ridiculous ammounts that they do.

just to let you know i spoke to Dartford Court and they advised me that i should get a date within a week and that I dont need to do anything else and that an AQ will not be required :-). YIPPEE.

WOW! Thats fab!!

 

I can schmell the money from here!!!!!!!!!!!!!!!!!!!!!!!!

 

Hubby & I were advised that our Woolwich/Barclays claim is being transferred to our local court down here too. However, think we may just call the court Monday to see how long we might have to wait for a court date,. as we have been expecting to wait about 10 weeks- ish!!

 

Which is waaaaaaaaaaaaaaay too long.

Hey Folks,

 

I must admit i am feeling a little frustrated :-(

 

Just spoke to the court (as I havent heard a thing from them) and asked them if maybe I had missed any correspondence etc as the claim was passed to them 2-3 weeks ago, they said NO :-(.

 

As many others they advised me that mine is being bundled with many others and that I would prob be given a date some time in Sept thats another 4 months away :-(.

 

Suppose have done most of the leg work now and just have to wait but its so frustrating, feel like ringing Barclays now but will hold out, suppose I have waited this long.

Its all down to the individual court hun, the banks tactics are fuelling and clogging up the process as much as ever, if not more. If it makes you feel any better I had to wait 10 weeks (after recieving AQ) before I got a court date.

 

I know its a pain hun, but you will get there and Barclays will lose!

 

Try to be positive - it could come sooner and anything can happen in between. Worst case scenario, its more interest for you.
