    • No u Unfortunatley I do not know who they were or how I might find out. the only details of the debt I have find just  mention debt managers.
    • Don't worry, Simple Simon of VCS/Excel is very well known to the forum, as indeed are his defeats, of which he notched up another brace only last week.   There is time to 5 February and as dx says, the defence need only be very short.  Get CPR off today and upload the correspondence in PDF when you can.  Just follow our upload guide.   A few questions.   1.  Briefly, what went on, how did your wife get three tickets?   2.  Is the person they are suing also the same person who was driving on the day?   3.  Did she receive a Letter Before Claim/Letter Before Action?   4.  Is this car park local to you?  If so it would be very useful to see pix of the signage.  You heavily hint that Simple Simon has mixed up Excel with VCS, and this has been fatal to him in court many times.

The contract between VEHICLE CONTROL SERVICES and the landowner that assigns the right to enter into contracts with the public and make claims in their own name. OR land registry details confirming VEHICLE CONTROL SERVICES as private land owner.    Asking this because their claim is worded ‘.The PCN(s) was issued on private land owned or managed by C.’

    • Hi all, good to see a well used forum on all subjects...I don't think this will be too common.   So basically I got a £10 credit for Casimba Casino and turned it into £1045, I have used the same debit card for the past 12 months, I came to withdraw and sent it to that card when I used the withdraw procedure.   After 9 days it wasn't in my bank so their support finally tell me they sent it to a credit card I haven't used in over years, one I had defaulted on when I lost my job! I am paying it off in a monthly agreement.   But this Casino sent them the £1045, I got in touch today and said that shouldn't have been sent, its Vanquis and they said they will ring tomorrow on a decision whether they will send it back, I don't think they will but any ideas how I can persuade them otherwise, this money will be a great help as I struggle to find a job in these times.

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

Powergen Charging Me Night And Day Rate Together

Anyone with a night and day meter might like to just check that the day meter stops when the night one kicks in. I just had storage heaters and an immersion heater taken out only to find that within a space of around 7 weeks i had managed to use £236 of electricity! Horrified I spent a week trying to fathom where it had all gone. 5 timers, a lot of creeping around in the dark and missing a lot of sleep, I eventually found that the day meter just carried on all night along with the night meter!!! Not only that they are charging me the wrong way round. They got real nasty and said it was impossible for this to happen and then tried to charge me £75 to come and put a test meter on which will only show that my day units don't tally and will, I would assume, suggest to them that my day meter is running slow. It wouldn't surprise me if they don't then try to charge me a whole heap more. They said they do not have the technology to check whether the day meter runs at night. Quite incredible!!! I, however, do have the right technology. It's called a camcorder. I'd be interested to know if anyone else has had the same problem. charlie

It does happen and you do not need a check meter fitted to tell this has happened. It just needs an engineer to come down and check and fix the time switch.

 

You just need to get through to somone who knows how they work and what they are doing. Speak to a manager and explain to him/her. Let me know how it goes. A check meter checks the speed of the meter and I assume it is running correctly, just not switching over correctly.

Check meter no use. The engineer arrived today and said that the check meter would be of no use whatsoever in this instance!! I'm now waiting for a phone call from powergen to admit their liability. All they want to do is fit a check meter to get my usage, which only reads a total, and deny that both meters can run together even though I have video evidence.

hi. yes you are right. after having storage heaters and immersion taken out my bill didnt drop as much as i thought it would. after checking nothing was using too much electricity by uising timers and switching various items off i ended up reading the meter at all hours. thats when i discovered that the day meter just keeps on going 24/7. so any night units i use are equalled by day units as well.

powergen rang me back and offered a refund of the amount on last bill!!! i refused tto accept this measly offer as they owe me around a thousand plus interest and expenses. it's now in the hands of energywatch. and i'll be getting on to small claims for expenses involved. hope this clarifies it a bit for you.
