      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hey all,

thought I'd introduce myself and start a record of my progress, sent the first letter SOA to nat west (my home banch) two weeks ago this coming friday, (recorded delivery) have heard nothing back yet so am getting my letter before action ready to go on Friday - total charges some 1500 (seems small potatoes to some of the claims on here!).

 

I have another bank account as a current account (although they are next on my list having just put the interest on my credit card up to an eye-watering 24%).

 

Couple of questions - should I still be sending to my home branch at this stage?

On the template - the blue writing concerning the office of fair trading - are people using this? and have you actually complained to them?

 

Anything else I should be doing at this now other than -reading, reading, reading?????

okay -

so nothing - no reply at all to my prelim letter, LBA ready to go tommorrow, have been reading the threads in the general forum and want to get myself fully prepared for a court appearance...... (I know this seems like I'm jumping the gun but, I just *know* if I don't it'll be me, standing in the court, looking like an eejit, making precendents in law and I'd like to have as much preparation as possible:rolleyes: ).

 

My account is 17 years old, and has been through many transformations, as a student account, a graduate account, a student account again when I did a post-grad, then a graduate account, then a normal current account.

Suffice to say - I don't have the terms and conditions of the account - can I ask Nat West to supply me with the terms and conditions and dates, plus a copy of my original signed agreement? would this be another SAR?

 

additionally I've been looking through the six years of statements (and boy do I wish I had the whole 17 years, I would probably OWN Nat West if I claimed it all back), and looking into the contractual interest issue - again can I ask for details with dates of the interest, both on arranged and unarranged borrowing that I was paying at various times? an SAR again, the same one, what do you guys think?

 

lastly, I had forgotton, but have remembered whilst looking at the statements, that at one point I had to convert my existing loan with them (which was on fairly favourable graduate terms), to a personal loan (with higher interest) to cover an unauthorised overdraft of 1200, of which at least 500 was charges. So they bounced direct debits, charged me for that, they charged me for having an unarranged overdraft, I paid an unarranged borrowing interest,they converted this whole bundle to a loan, plus hiked the interest on the loan I already had because it all *had* to be together, and I paid a high rate of interest on this over the next 2 years.......(and might I add the graduate loan I had was because they stopped my overdraft facility whilst I was 2 grand in debt whilst I was still a post-grad student, and had no choice but to convert to a loan in the first place....gotta love'em) Do you think I can add some of this into my claim....?

Its going to be complex, but in for a penny...

Soooo...... I've been reading and I've decided its too complicated for little old me to work out which portion of the interest I paid monthly was on my arranged overdraft, which bit was on unarranged borrowing and which bit was entirely due to the charges levied - and be able to have it my head well enough to defend... (even with the spreadsheet), but I have been able to work out which portion of the interest on my loan was entirely attributable to transfering the charges in the months immediately preceding it into a part of a loan.

 

I've added my calculations to the charges schedule.

 

My LBA is now ready to go off to Borehamwood tommorrow, with a copy of my prelim letter, the charges schedule, all registered post.

 

I sort of can't wait to get to the court bit really - I think I am annoyed that they havn't responded to me at all, quite fancy having "my day in court" and I now have my sights on my other bank account, which has about £1200 of charges.

LBA went recorded delivery on Monday,

 

offer of all charges refund received from Stuart H yesterday - in response apparently to my first letter, dated 23rd February (arrived 8th March - nearly 2 weeks after date - gosh that post is slow ;-) ).

 

"do not agree with the basis of your complaint.... charges we levy are for providing services and they are not penalties or charges for default....gesture of goodwill without liability or error......" blah blah.

 

Inclined to accept but am looking for wording that states that this is a full and final settlements against my complaint relating to the dates and charges in my schedule only.

 

Also - for those who have been here before - how long did it take NW to get the money into your account (if indeed they have), I am still going to ready myself for taking them to court...

 

but still a positive result I feel!!!!!

no it wasn't with interest. I looked at the costs of starting the court process and the time and hassle, and for me the interest wasn't worth it. Which is obviously what the banks are counting on.

 

I appreciate that this not the case for everyone. I believe that we are entitled to the interest and if i'd held out and pushed for it, I probably would have got more.

 

but having the money quickly allows me to pay off the debts in a specific order go after the others, so for me this is a good result.

 

and I've got LOADS more confdence now, so won't roll so easily on the next lot:rolleyes: .
