Hi

 

just recieved a reply to preliminary approach for charges from nat west stating -

 

 

'We believe our charges to be fair, reasonable and transparent......we have considered and responded to the office of fair tradings statement 5th april. we do not accept that the office.FT.... in relation to credit card fees (not sure about this claiming account fees). we are concerned that the office.FT....has publicly called into question the setting of charges applied to other products, including current accounts. The office.FT... has restricted it's investigation to credit cards and made no attempt to consult nat west or the industry in relation to other entirely different products'.

 

Have sent an LBA today, has anyone else come across this legal jargon? or are they just trying to put me off.

I delayed the MCOL as Nat West made an offer, I refused, masses of letters from 3 different offices followed.

 

Submitted MCOL on 16th Feb, recieved a letter yesterday - back dated to 15th Feb - offering original claim less interest or court fee.

 

Just a few questions for anyone reading this thread, should Nat West make this offer through the court? it's only part of the calim should they offer a defence? do I contact the court? if I accept, will I loose the court fee? I really need the money, looked through the FAQ and template letters can't anything referring to these.

 

Been following loads of other threads, seemed Nat West just decide at random whoch calims to pay, delay or go to court.

I suggest you send them a letter back (yopu'll find one in the templates library) detailing the value of the charges, your court costs & the interest thus far, & telling them you'll accept their offer as part settlement. While they continue not to pay up in full, your interest increases, so keep going with it. No need to tell the court, just keep copies of everything you've sent to them, just in case.

YES - I received exactly the same letter as this person from NatWest...basically I was told that they were not happy with all the publicity that has been generated in the media as a result of the so called OFT ruling, to the best of their knowledge, they do not believe that the ruling applies to current account and that I was mistaken, they continued to state that they had viewed the OFT article and it was only limited to credit cards, then went on to say that they have not been approached by any governing body to advise what they were doing was wrong, and until such a time when they are advised to basically stop what they are doing to customers, then they would continue to penalise my account in the same way! I sent the other CSA template letters including the final request, and even then I only received a five line reply stating (and I quote) "We have repeatedly explained our terms and conditions to you in relation to how we nomally operate current accounts....if you are still unhappy with the way in which your business is being conducted with us then please contact the Banking Ombudsman".

What frustrates me most is not just the 4,600 they owe me, more so the fact that they have not even apologised for the level of service that I have received, or even that they consider me a valuable customer which they do not want to lose.

Jo, if you havn't already done so, start a thread in the natwest forum, you will also find similar situations posted by others.

 

If you really don't know what happens next, then you need to do some reading and quickly. You really need to know what is going on at this stage, have another read of this

Thanks for all the help, I'll look again at the bank templates and send a letter accepting as part settlement.

 

Re read Nat west letter and realised they added 'gold account' charges in their reference. I didn't include these in the claim however, I transfered the an ordinary account in December after the bank mislead me -stating that this account had lower interest charges and 'benefits' for overdrafts.

 

Think they are trying to cover anything relating to misrepresentation.

Sent letter declining the offer today.

 

Not sure how to approach this - I was offered a loan and accepted on two occasions - to cover my overdraft. The bank advised me to take out an avantage god account at £12 a month as this offered better interest rates, I've since discovered that I was mislead and written to the bank stating this and returning the account to an ordinary account.

 

I read that this mis-information is illegal and the CAB have taken banks to task over this and in some cases loans have been cancelled. I noticed that they had lumped my comlaints together and added the words 'advantage gold charges' to the offer.

 

Not read any threads trying to claim back charges and compensation for laon advice.

It's very hard work but it might give you an idea of what you are up against.

 

If you feel that you were misadvised with regards to the loan, you could contact the Banking Ombudsman. If they are offering you repayment of Advantage Gold fees that's a new tactic as far as I'm aware as they have always successfully defended that as a service charge.

 

If you have issued court proceedings then you are entitled to recover the cost of doing so, provided you gave them a date by which they had to respond. If you have followed the templates in here then you can insist that they repay your costs.

that made interesting reading.

 

I only calculated account charges re defaults, unpaid direct debits etc and have just renegotiated another mortgage to cover the loan taken out to pay off overdraft. Been advised to take out loan twice by Nat West to cover overdrafts and convert account.

 

Complained about the loans as a seperate issue, , Nat West put them together in their offer, will definately consider claiming for misrepresentation/bad advice. Taking my evidence to the CAB as I read they have some expertise in this area, keep you posted with progress.
