    • Yes that looks fine. It is to the point. I think somewhere in the that the you might want to point out that your parcel had been delivered but clearly had been opened and resealed and the contents had been stolen

You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? The claimant seeks reimbursement of £265, plus P2G fees of £9.10, plus postage costs for two first class letters to P2G of £2.70, plus court fees, plus interest.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Would like to say Hi, Thanks to those involved in running this Forum, Like many others I watched the BBC last night and was quite disgusted at the blatant theft of my money!

I have just checked back the last 6 mths on one of my Abbey accounts , resuilt is that my Charges were £170! I havnt even started yet but I would expect my total figure to be in the region of 5K.

An interesting point is that my charges are applied on the 14th of each month, I wonder if this is the standard date, is it a coincidence as that is the date when my account is at its lowest as my wages go in on the 15th? So the cahrges send my over my limit?

So for now I am about to start the reccomended reading, Here goes!

You've definately taken the first step into claiming back what's rightfully yours.

 

Spend time reading the FAQ's and the Step by Step guide as this will stop you making mistakes along the way. Use the letters and spreadsheets in the Templates Library as these have all been tried and tested in successful claims. Read as many threads as you can especially ones that relate to your bank. This is a SELF HELP site and won’t do the work involved for you. However, everything you need is on here somewhere.

 

Don't be afraid to ask any questions, no matter how stupid they may seem, but please remember that any advice that you receive is normally based on experience only and that you should seek expert advice if required.

 

Once you start the process of your claim remember to open a thread in the relative bank forum, this will enable you, and others helping you, to keep track of your claim.

No I havnt asked for it to be changed. to be honest it never really occurred to me until I started looking into the entire situation since the tv programme. I think that I will sit tight until I have done my reading before approaching the bank about anything.

Welcome.

 

First and foremost, before you start please have a thorough read of the FAQs. This is a must, no excuses. There’s a Step by Step guide here too. You should print these out to refer to later, so as to avoid having to ask basic questions.

 

You need to spend 2 or 3 days gradually getting your head round everything. If you find a forum/thread/post of interest, save it in your Favourites, so as you can always find it easily. Here’s one to start with, which you should find useful later:

Hi All

Abbey apply my charges on the 14th of each month. It occurred to me that this may have something to do with the fact that my wages go into my account on the 15th, this means I am often at my limit on the 14th and the charges send me over resulting in more charges!!!

 

Q: Is the 14th the standard date for ALL Customers?

Does anyone have similar?

5.3 Interest and charges will normally be credited or debited, as appropriate, to your Account on the same day each month, unless you have requested a change of statement date. We will give you at least 14 days notice of interest and charges for standard account services to be debited.

 

 

My statements run from the 10th of each month, and charges debited on the 2nd.

 

I believe you can request a change of date, and have a feeling thats what I done a few years ago.

Hiya

Newbie starting procedure today Im sending to Abbey address 2 triton square. Some people seem bothered that the abbey will have a hissy fit and close their account. I couldnt care less as I have found the abbey to be totally rubbish in doing as you request but brilliant at charging you. We also had charges taken from our account the day before wages went in and on the actual day they went in but told the charges were taken from our account at Midnight and wages went in at 3am so we ended up being charged again for going over our OD limit.

Including myself, this is 3 people with the same situation, are there any more??? Is this something new that has cropped up or is it typical?? jUST WONDERING wHETHER IT IS THEIR POLICY TO DO THIS?? iF IT IS THEN THAT IS JUST OUTRAGIOUS!

Glenn, have Abbey ever changed the date they take charges out of your account? I doubt it.

 

Whilst I will never defend a bank, I think you are worrying about something that just happens automatically.

 

If the day the charges come out of your account is not convenient, and lets face it, it is NEVER convenient, then ask them to change it.

 

For Abbey to make it a policy, they would have to study your account for several months, and then decide the exact date when it is most problematic. Lets face it, it aint happening. Statistically, with millions of customers, some will gets charged on the 1st, some on the 2nd, some on the.....you get the picture.

 

They are charging unlawfully, and that is as bad as it gets.

Hi I have 3 accounts with the abbey, 2 personal and one joint and the bank charges all come out at different times. On one account they come out on the 3rd another on the 9th and the other one the 30th!

 

One other thing my card covers all accounts but it is mainly for my main current account. Abbey cancelled my card. I didn't know until I went to use it and when I rang abbey was told that as I was almost at my overdraft limit and there were charges coming out of my main account in a few days time abbey wouldn't let me use my debit/cash card and I had to go without money for 2 weeks as the charges were in the region of some £200. (I get tax credits every monday and they were eaten up by the bank charges!)

Louis, I get ur point but it just seems bit fishy! Of all the days the charges could be taken its the day EVERY month that I have least in my account.

 

I don;t expect/want to take this further and I will get the date changed, I was just wondering if this is common practice and would like to know.

OK Guys, I am just about to begin my correspondence and have a couple of Q's.

1. Ref; my Subject Acess Request form, Shall I send this to the address at Triton Sq, London (as per forum) or the address on Chq book @ Prescott Street, London.

2. Shall I send a copy to Customer Satisfaction Centre.

 

Do these letters need proof of posting/delivery?

 

On a slightly different note, Over the years I have regularly changed Credit Cards but now I have no account details for them, Can I send the above forms to various Credit Card Companies without account numbers?

Send letters to them explaining what you want, explain that you will satisfy any identity issues, but if you havn't moved house, your address should be enough.

Need some advice now please, I have 2 current accounts with Abbey, I have receicved statements for last 6 yrs for one account but have only received 50% of statements for the other. So shall I continue with my claim for the first account, OR Contact ICO to complain?

I have tried to speak with Abbey but just receive polite response saying blah, blah, blah, although I believe it is their system cocking up rather than deliberate delaying etc

Glen, do they have any time left on their 40 days, if so, then you'll have to wait.

 

If it's expired, there's a a non-compliance letter in the library, have a look and send if it you think it's a ppropriate.

Thanks Louis, no their time is well ellapsed but as I have been speaking with them they keep re-ordering the statements but the statements don't arrive, so I can't wait forever so will send the letter,
