    • His financial situation isn’t great, and the landlord has made lots of things up. The things he’s put isn’t true at all. My friend did tell the full truth with incoming and outgoing, I helped him fill in his form and he checked bills etc. to make sure it was right. His wage is ok, but not as good as the landlord thinks it is,  and he doesn’t have anything spare. How much are they likely to take from him? Should he send any reply?  the letter just says to take the court letter with him. 
    • Hi and thanks It looks like they ticked all the boxes to me but I'll try and upload the notice. I was wondering if a witness to late delivery might be considered proof - I'm assuming they posted it as normal but Royal Mail stuffed up delivery.     • Hi welcome to the Forum.  If a PCN is sent out late ie after the 12th day of the alleged offence, the charge cannot then be transferred from the driver to the keeper.T he PCN is deemed to have arrived two days after dispatch so in your case, unless you can prove that Nexus sent the PCN several days after they claim you have very little chance of winning that argument. All is not lost since the majority of PCNs sent out are very poorly worded so that yet again the keeper is not liable to pay the charge, only the driver is now liable. If you post up the PCN, front and back we will be able to confirm whether it is compliant or not. Even if it is ok, there are lots of other reasons why it is not necessary to pay those rogues.

My understanding is that this is outside the window for notifying. The issue date was 08/04/2024 which should have been in good time for it to have arrived within the notice period but in fact it actually arrived at lunchtime on the 15th. Do I have to prove when it arrived  (and if so how can I do that?) or is the onus on them to prove it was delivered in time? All I can find is that delivery is assumed to be on the second working day after issue which would have been Weds 10//04/24 but it was actually delivered 5 days later than that (thank you Royal Mail!). My husband was present when it arrived - is a family member witness considered sufficient proof?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My child has grown up, got married and made me a Grandma in the meantime - 39 pages???? And she's still not done yet ??????

Hedgey, I know you must be a bit upset about the closure of Fendy's thread, but in the end it was inevitable. Yes it created alot of comraderie between all us claimants,

but i think Fendy would agree that it had gone off track, and for anyone wishing to follow what was a really interesting claim. Especially new people to the site it would have been a nightmare to pick up the thread of the claim. So please continue as normal and we are all here to help you fight for what is rightfully yours. Good luck.

Fendy's thread has been closed as it is extremely difficult for a mod (when asked for direct help as Fendy did) to trawl through the off-topic stuff and find the information needed.

 

If you can't help yourself, then it's difficult to see why someone who works for free should help when their job is being made more difficult.

 

Fendy, you were asked to take out the relevent bits and move them so it would be easier to help you. You refused on the grounds of "I don't have enough time".

 

Perhaps you should go to the other site that you quite blatently talk about here, in direct breach of the forum rules (it's a commercial site) - I'm sure with the amount of members they have, they will have plenty of time to sort through your threads over there for you.

Im not getting into a retorical argument here. But

a) I have a part time job, 3 days a week

b) I have 8 claims ongoing

c) I have a 2 children, a dog and family responsibilities to organise.

d) With a thread that has over 118,000 views, how the heck, am I supposed to find the time, with everything coming to a crucial head, particularly with the nutwest and shabby claims

 

to go through the entire thread and post individual posts of number. How am I supposed to have time for that ?????

 

I would rather the thread was deleted. Seriously. As it seems it is no use to anybody, not even on the encouragement and support front. So Im fine with that. JUST DELETE IT. Im a firm believer in the good of human spirit, and also a firm believe in LIVE AND LET LIVE. Just a pity that those who complained about threads on here (not just mine, but plenty of others), dont seem to believe in the same philosophy.

Fendy, whilst I sympathise with your plight, this is a self help forum.

 

I have two children, two houses to look after, 2 cats, an ex wife, a girlfriend, a full time job, this site, a part time job, 3 claims going through for myself at the moment, plus about at least another 15 for people I know.

 

Yet, I would still find time to help myself and not push the burden onto someone else who equally has a life to lead as well.

If the thread had abided by the forum rules from the start, this wouldn't need to have been done.

 

 

Due to other sites that have copied this one, there are a multitude of cases that are attempting to be thrown out - embarressed PoCs for example - we have taken these cases on, with our own money and our time.

 

Having people refuse to even help themselves, helps no-one.

 

You obviously have a chip on your shoulder about this site and the fact that people have asked you for help to help you.

 

I suggest that now your claim is nearing it's end, perhaps it's best that you stop and go to the 'fun' sites.

 

I don't want to have to close this thread too - let's leave it to get back on topic and forget the highjack.

I had offered to Janet M that I would split the thread, once my Natwest claim was over, when I had time to then do it. Obviously that wasnt good enough. The thread was closed anyway. Look, sincerely, no hard feelings, Im not that kind of person. I understand. But I thought later was better than not at all.

 

I wish everybody on CAG, everybody, all the very very best. Keep up the fight and you will all get your money. Just read, read, read, and remember if you can help each other along the way, encouragement, moral support, camaraerie, then it all helps, it absolutely does. I feel very hurt, but what can I say...................

Hedgey, i loved the fendy thread (the madness of it- my term). It was fun IMHO. I understand why it got locked but it showed the real life waiting and was a diary of a claim almost as good as any book you could read.

Nattie is on the other site which is not a commercial site (i found the info out as i stated before), i would never endorse ambulance chasers and never did when i posted regularly on here. It gets its money from wasted costs orders and expensives which can be legitimately claimed(that is for those who eiither have no time to do the claim or feel unable to do so themselves). The site is self help and free. I am a banana(do a search on yahoo uk)

Hedgey, you are the one i am now watching for that cheque through the door, and we will keep the madness of the fendy thread alive elsewhere which is not a dig at anyone.

Thanks Meldrew. I know you'd never endorse ambulance chasers - you're a genuinely decent, honest, lovely person who I've missed terribly for a while now. You was the absolute backbone of the nat west forum, always supporting and advising peeps and ensuring that we felt empowered to take action against nat west. You've inspired me from day one and your tireless and selfless actions inspired me to empower myself with the knowledge needed to help other peeps on this forum in the same way that you've always done. I sometimes make a mistake, but my heart is genuinely in the right place and I hope I haven't let you down too much.

 

I'm truly, truly upset at what's happened today, I feel really sad at some of the posts I've just read. I struggled when you left the site, but today's occurence has really taken the wind out of my sails and knocked the stuffing out of me. Fendy is an incredible woman who's become a personal friend who, like yourself Meldrew, inspires me and many others. Her honesty, bubbly personality, tenacity and accounts of her day to day battle with nat west have been a source of inspiration to me and many others. I will truly miss Fendy on CAG, as I miss you also and I feel the nat west forum will miss her also.

 

However, I do need to retain my own claim against nat west - those of you have read some of my posts in the paost will probably be aware that my financial circumstances are (like most members I suspect) not in the best state. I will post genuine claim updates only on this thread in future to ensure that peeps can respond to genuine requests for support. Hopefully, this will enable me to continue with my claim against nat west and enable other peeps on the forum to understand the process. I appreciate all the advice and support I've had in the past from forum members (Parkie, Steven, Nattie, Fendy, Enaid, Archer to name just a few) and hope to continue to receive this in the future.

Hedgey, today is a bad today but tomorrow will be better. Each person deals with claims how they see fit. You know where i reside (mse and pc and LB) and now where fendy is stamping her mark moreso than me now(lol as i write that). Hedgey, I have been here for some time, and still visit to see your name down the NatWest thread and when i do and i did, I knew that the forum was safe, because you understood a lot of the things that i posted. I remain convinced that your knowledge is really good. It is difficult to get someone to fully understand how a system or charges work or how bank procedure works. I am sure i would have to sit down with you for a week to get an understanding of what happens and the psyche of the banker. You got the basics on the charges and I think fully understood threads that seemed not to sink in for others. I am certain that while the rep is on 2 bars the rep that you deserve is so much more. Keep your chin up, you know where i am as Nattie. It is one year for me on the charges sites soon, I will be having a cracking gift for NatWest on that date, they love me really:D

dave is right that this is a self-help site but it is not just a self-help site. It is also a mutual support site and IMHO the sort of support given during the long waits and the quick panics of receiving a letter from Cobbets or the court in "off topic" posts is invaluable and the site wouldn't work without it.

Claim update - letter going off to cobblers in response to their 'defence', copy to county court:

 

Dear Cobbetts,

 

On 14th June 2007 I received a copy of your defence in the above case.

 

You may not be aware that your client has previously offered to return all penalty charges applied to my current account (copy of your client’s offer letter attached). However, as I filed this claim at xxxxxxx County Court on 15th May 2007, I am unwilling to accept any offer that does not include the court filing fee of £120. Please find attached, a copy of my response to your client’s offer, which they have not responded to.

 

Should your client wish to settle this claim amicably, I am prepared at this stage to accept a full refund of all charges plus the court filing fee of £120.00.

 

For your information I attach a schedule of the charges I am claiming back.

keep up the good work girl, they defended mine to the b******s but at least in your case they offered all of your money back minus the court costs, they never even attempted that with me!
