      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Afternoon folks!!! Right, curiosity got the better of me (I know patience is a virtue parkie, but I'm not very virtuous!!) :D So, even though the little darlings at the CRU have got until next Friday morning to reply to my LBA I though I'd give them a little tinkle.

 

Spoke to lovely young man who couldn't find a record of my prelim or LBA (even though both were signed for!), told me they had up to 8 weeks to respond to me (no you don't!), said if I had sent in a claim it would have been send to Edinburgh for 'verification' (what?) and that I had to understand that they're snowed under with claims at the moment (yes honey, I know......... I chat online with all the other lovely claimants!!)

 

He asked if I'd sent a schedule of charges in, to which I replied "of course I did, and when I sent you the LBA I showed you an additional column that highlights what my claim will cost you in additional funds if I have to take the claim to court". "We know what it costs to take these cases to court" says he. WELL IF YOU KNOW WHAT IT COSTS, COUGH UP AND GIVE ME MY MONEY BACK INSTEAD OF LINING THE POCKETS OF THE COBBETTS LAWYERS!!!!!!!

 

So, if I haven't got anything in the post by next Friday (strong possibility seeing as he couldn't even see anything to do with me on his computer) it looks like I'll be filing at court!!! Bummer!!!

 

Looks like there's no rhyme or reason to who they payout to at LBA stage....... cos my claim's only for just over £1100. Grrrrrrrrrrrrrrrrrrrrrr :mad:

Hedgy do the filing I love it, done three now, but for all the bloody typing which I am non too fast at, I think I'd make it a full time hobby. Just the thought of them getting something from court that has been started by little old me, I think it's wonderful.

And then knowing that you are going to win makes it bloody fabulous:D

Think I just let that young muppet get on my nerves a bit too much........... can't be doing with condescending people - they're so unnecessary!!! And I'm mad at myself for not being patient enough to wait till next Friday as well........... I'll be bricking it for the next week now in case they've never even had my claim in the first place!!!!

Exactly!!! Cheeky young s*d said "when did you send it" - meaning the LBA. So I said "sent on 18th, you received it on 19th". So he said "what do you mean, we received it on the 19th", so I said "somebody signed for it - and I've got the signature to prove it!!!!!". "Oh right" replies young muppet!!!!! So they can bug*er off if they say there's no record of it, they can bug*er off if they ignore me completely, and they can pay out the bl*ody interest and court fees plus cobblers fees as well!

 

Hahahahahahaha........... along with all the other claimants on here, we should make a nice big dent in their profits sooner rather than later!!!!! xxxxxxxxxxx:p

Well I've done with Nastywest for now, but my sweet D**K H**D of a son has had 3 more 28 quid charges since i got the last lot back for him. I thought I would wait until about Sept, see if he gets anymore and then I will be back and get him some extra dosh for xmas. Bit like saving up for him really:D

I agree with every last word of that post Enaid, there is definitely some sadistic sort of pleasure in filing MCOL Hedge, really, there is............ And the feeling of not getting an AQ with me, I felt robbed............. It all gets a little mad this filing claims thing. Its like a different person takes over your body and mind and makes the whole experience thoroughly enjoyable rather than frightening. Lol. Weird, what a bit of a power struggle can do to you. Lol xxxxxx Its faffy I know filling out claims but well worth the journey knowing ultimately you are going to win, and a nice little 8% on top of, makes is sooooooooooooo worthwhile. Chin up Hedge, you and your money will be reunited, just might take a few more months thats all. Lol xxxxx JOIN THE CLUB. ITS CALL THE "LETS ALL SIT AND WAIT CLUB" Lol. I have received a copy of your Aq today. When your defence was filed as I didnt' understand the defence I rang Northampton to clarify for me. I was told that it was the Judge who would ask for more information on my claim and not to worry.

Having heard nothing from yourselves or anyone else since then I took her advice and sent in my AQ

I have enclosed a list of charges and interest and I will hand one in to the court today to add to my file. If you require any more PARTICULARS please don't hesitate to ask.

Happy Saturday Hedge.......................... been gardening all day. Got loads done, including erecting one of those garden swinging hammocky thingies.............. Oooooooh my gardens starting to feel like Im proper in the Med now........... Bliss................... and can buy a few more lovely fruit trees when my Nutty West spondoolies come through. So far Ive planted, Apricote Tree, Peach Tree, Loquat Tree, Plum Tree, Apple Tree, blueberry bushes, blackberry bushes, gooseberry bushes, strawberries, kiwis, banana tree, 4 grapevines, 2 white, 2 red (because I just had to Hedge), you know, the vino of life,,,,,,,, lol and Hazlenut tree, and gorgeous, almond tree,,,,,,, yaaaaaaaaaaay, my gardens going to be a productive little garden this year. Yaaaaaaaaaay for organic fruit and veggies all home grown, cripes Im enjoying the garden this year, and it takes my mind of the Nasty West nutters delaying my cheque. Lol xxx Fend xxxx

Got no news yet........... and the LBA deadline's tomorrow (even though I'm mentally giving them till Friday!!!)

 

Pretty peed off to be honest, cos I think I'd convince myself they'd pay out at LBA!!! IT'S ONLY JUST UNDER 1200 NAT WEST.......... GIVE ME A BREAK AND COUGH UP!!!!!!!
