      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Congratulations I am hoping to hear from MBNA today on the phone ( if they ever ring me back ). Did you claim your intret back too.... ?

 

I claimed back £550 worth of fines and £260 in interest and they have said they will pay it all back. I will await the cheque :)

Just a run down to what has happened so far...

December 21st 2006, - Sent first letter asking for £550 fines and £260.81 interest. (accidently sent LBA instead of Prelim!)

January 3rd 2007 - Received letter saying they are looking into it.

January 19th 2007 - received letter stating that they did not agree with OFT but would send £270 cheque (goodwill gesture?!)

January 25th 2007 - received £270 Cheque (did not cash)

January 25th 2007 - I sent 14 day LBA (was away on business so was not tracked)

February 8th 2007 - resent 14 day LBA (MBNA did not receive last letter so sent again!)

February 20th 2007 - I phoned Customer Advocate Office – they have 28 days to respond under FSA guidelines so nothing till March 9th as busy!

February 23rd 2007 - I sent the 7 day before court LBA (received and signed for February 26th at 8:36am)

March 5th 2007 - phoned Customer Advocate Office, informed them I was not happy. They promised I would have a call by end of Tuesday 6th of March. I promised to not file a claim till the end of Tuesday.

Tuesday 6th of March – no call by end of day but due to work I was not able to do any more till Thursday 8th of March. As MBNA were due to respond by Friday 9th of March thought I would wait and call the next day and if no luck then file a claim.

March 9th phoned MBNA mid day, said I was not happy as they did not return my call and would like to have a response today. He mentioned 28 days and I would have a response in the post, I mentioned that was today, tomorrow would be outside that deadline. He said there would be an offer in the post, I said I could not wait any more time as this had been going on for too long (since 2003) and I was tired of it and would rather let someone else sort it. He said I would get a call back, 15 minutes later they left a message on my phone to say they would refund £540 in addition to the £270 they had already given me.

March 10th receieved letter in the post to confirm offer.

March 15th received Cheque

March 16th put cheque into account!

Awaiting it to clear! :)

come on Nick - think! do you buy anything from mail order catalogues? - has the milkman overcharged you -check your Tesco receipt have they chaged you twice for something?

 

Hmmmm.....got something from Currys and was not happy so I have already complained!! I do now appear to have become Victor Meldrew and complain about everything!! My Fiance just keeps her head down now!! :)
