i sent off the first letter requesting my money back. £1140. The wrote back saying they would give me £520. I wrote back saying i would accept the 520 a part payment but would be going ahead with action to reclaim the rest. Not sure if they had my reply when they replied to me but they have sent me a chq for 520. They have until 21/2 until i file at court. My question is should i cash the cheque before of not. could do with the money!!

You can accept the cash and persue the rest, you need to ammend your Schedule of charges to remove the charges they have repaid you. However you need to add the interest on these charges upto the date they paid them back when you file this claim at court. Hope that makes sense, you could however return the cheque and continue as normal.

just worried that if i cash the chq the could say i settled with them

 

 

Send the letter in here that is applicable. If you can wait for the cash then sending the cheque back may be easier. This avoids any confusion with interest etc.

Also, ensure you deduct the £520 from your LATEST charges.

 

That way you can claim a greater amount of interest.
