You would have to upload the image to a web site then link the file from there into your post using the 'picture' icon (Insert Image).

It's hard to be sure from the copy & paste data, but it looks OK at a glance.

Oh damn. I've just noticed the last reply. If interest is taken out twice in one day. Do i have to add them together such as 30/04/2003 where there are two going out £5.00 and £1.20 = £6.20

Is there anything else I can claim for apart from the penalty charges (£1015.20) and Interest on penalties (£130.07)??

If there's more than one lot of interest on a given day, just total it into one entry.

When you get to moneyclaim there's the DPA fee (if paid) and postal costs (recorded/special delivery). You will also be able to add the 8% s69 interest (already calculated on the last sheet of the spreadsheet), and a daily rate of interest from the date of filing until settlement. They also have to pay the court fee (but you don't claim this as part of your claim value, it's added automatically).

Thanks a lot for your reply wife.

I've checked the last sheet (8% sheet) and it seems to have calculated in okay.

Right. Now to send of my LBA and see what materialises from that;) . Nothing I would imagine. So then it will be moneyclaim

Sorry to appear stupid but this question may be I filled in spreadsheet with 8% interest no problem . When I fill in advanced spreadsheet and put in debit balance etc trying to work out interest figure I have been charged on my charges the 0 box doesnt change am I doing something wrong ? Do you understand what im asking ? I understand we can claim 8% when at court but if im being charged say unauthorised rate for being over limit that is much higher than 8% on all balance not just the charge portion I m trying to get back . Sorry to be a pain help !! Regards Gary

The interest calculation for the line takes into account how much you are overdrawn and how much of that is due to the accumulated charges at that date If the balance you entered is positive (not in overdraft) then it will calculate as zero. It will also probably show very small amounts to start with as the charges proportion is low, but increasing towards 100% of the interest charged as you get more charges added.

If the problem is due to having a positive balance then look for the greatest overdrawn figure in the month before the interest date and use that instead.

Hi. I've used the advanced excel spreadsheet and put in all charges and interest. I'm just wondering whether I've made a mistake with the claim dates I've entered in to the notes tab. I've put in the start date for the claim which I took as the date the first ever charge came out, and then I've put in the end date of the claim as the date I sent the prelim letter - 9th August. Is this right? Or should I be changing the end date each day?

The reason I'm asking is that the 8% interest totals have remained the same since I made the spreadsheet and from what I understand, this amount should increase daily from the date that the charge first occurred until the claim is settled. I'd really appreaciate it if somebody could let me know if the 8% totals should be increasing daily or if I've got the wrong idea completely. Also on the notes page it says to enter the date in words so I've tried entering both 9th August 2006 as well as Ninth of August Two-Thousand and Six. Neither affect the totals but I'm not sure which way is right.

Thanks a lot to anybody who can help me.

Leave end date as the formula '=TODAY()' for now. This will always show the current date. It only gets locked on the date you file your court papers, when you change it to that date. The date on page 1 is just to formalise the Charges and Interest sheet for printing and sending to the bank/court.

I only have two charges prior to June 2003, in April and September 2000 (@ £20 a time). Should I still enter the interest charged for the period between September 2000 and June 2003, even though no charges were levied? I was still overdrawn.

Yes, as the charges were part of the overdraft amount. The proportion will reduce during that time, but that's OK.

I enter every single bit of interest that has been taken from my account, starting from the period in which the first bank charge was made. But when do I stop?...do I keep entering the overdraft interest until I'm finally overdraft-free (sometime in 2005), even though I incurred no further charges after 30/1/04?

Input the interest from the first charge date up to the present. The charges are still part of the overdraft on your account and are causing at least part of the interest you are still being charged.

Miss out months where there's no interest charged (or just put zero). Don't leave any gaps in the list though.

I think I'm starting to understand the principle of historical interest and its impact on my balance today. Let me put it this way:

Let's say I have a tall cylinder of water with a red line half way down. Whenever the water drops below that line, we say I'm in overdraft.

When I add wages, credit etc, I add a cup or two of water. When I spend money from the account, I take some water out.

If I drop below the red line, the cylinder develops a leak (overdraft interest) which doesn't stop until the water is topped up above the red line.

Let's say after a year of leaks and water being added and taken, the level is now consistently above the red line; perhaps a wage increase or a loan was taken out and more water is going in each month.

Now let's say a further year on and the water dips below the red line again resulting in a leak - not because of an unlawful bank charge, but in the normal course of spending/outgoings.

Are we saying ultimately that we can claim for some of the water back from that last leak - even though a bank charge was not the cause - because had the penalties and leaks not been taken out of the container 3 years ago that there would have been more water in the present day and the level would possibly not have dropped below the red line?

Excuse the metaphor, but it's the only way for me to be able to picture it!

One last thought...say you get credited with interest when your account is in the black (0.1% - cheers barclays, i'll buy meself a bottle of moet!); could you theoretically not claim for lost in-credit interest on the amount that you would have been in credit had they not taken out their charges and interest? :D

Whilst the charges are still a part of the overall balance on the account they have an effect on the interest you pay when you are overdrawn (if they hadn't been taken out the water level would have been above the red line for a lot longer, therefore less interest charged).

The credit of interest is covered by the 8% s69 interest when the court papers are raised, or optionally you can try to reclaim the loss of interest at the contractual rate instead (20-30%) but no longer be able to claim the 8%. This has to be done as part of your claim value in your letters to the bank.

As I am still quite new to this I don't know how to post a new thread within this forum about the spreadsheets without doing it as a reply. Hope it's correct.

I have been directed here by thewifeandI looking for help from anyone with knowledge of the interest calculation on penalty charges in the england excel advance credit card spreadsheet. I posted a thread in general forum before and so far two moderators have very kindly replied but unable to shed light on this for me.

I am getting a higher figure for my claim for interest on penalties than the actual interest the cc co. charged me.

figures are:

interest charged £74.46

statement balance £5,524.29

amount paid £5,399.86

remaining balance £124.43

penalties chargeable to interest £180

interest on penalties £107.71

Please help!!:)

Hi. Does the spreadsheet work out the 8% interest at AER or APR? We're posting letters before action today and are going to go for contractural interest at 29.8% which, on Lloyds website, is described as AER. I was just wondering which rate to put after informing them that we are changing this interest - or would it be better just to leave it as 29.8%?

Thanks a lot.

I don't have a website. Only thing I can think of is if you insert the figures in the spreadsheet template you would get the same result.

I'd just put 29.8% - they should know where it comes from!

The problem is that the figures accumulate, so it depends on what is on the previous lines as well.

Apparently in the UK, AER (also called EAR sometimes) and APR are exactly the same thing.

Mindzai & Lucid vs Lloyds TSB

Mindzai's Account - Partial settlement offer rejected

Joint Account - Partial settlement offer rejected

Spreadsheet for compound contractual interest and statutory (s69) interest:

Download v1.9 [Tested with Excel 97-2007 and OpenOffice 2]

PLEASE NOTE: You should fully research contractual interest before you use that functionality of this spreadsheet. If in any doubt please use it to calculate 8% interest under s69 County Courts Act 1984.
