      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Having debated over starting this for a few months, I sent off a Data request letter on the 12th January, and am currently eagerly awaiting the result. I also included a cheque for £10 with the letter, which has been cashed around the 16th, so I'm not sure why I haven't had the statements yet :/

 

I'm wondering how far it will go, how much it will all be (had a horrid period a couple of years ago when my partner walked out leaving me with a brand new mortgage to pay and no savings - meaning I copped for a lot of charges!) Will update as and when I go along.

 

Wish me luck everyone - and if you could advise me how long to wait for the charges I would appreciate it!

Hi, noisypinkbubble, welcome. It goes without saying that we all wish you luck!

Be prepared for it to take the full 40 days to receive your data info, then it'll be a nice surprise if it comes sooner. From the date you mentioned it shouldn't be too long now.

 

As for 'how far it will go', if you want your money back you should count on it going all the way to lodging your claim with the courts.

 

If you have taken time to have a thorough read round the forum, you will know how scary this process can be - but also that it is succesful and worth the time, effort and emotional scarring!

The full 40 days (if its just days, not working days) should be the 26th - and as of yet still nothing! Well, they managed to get in touch to say they had charged me £50 in unath od charges when the online banking had shown no such thing (and I'd been checking every day) as THEIR interest being taking on a different day put me over the limit. I can't WAIT to get all my cash back off them, I just want to know how much it is!

they warn you of the unauthorised overdraft charge well in advance so i am afraid it may suddenly appear on your account- for some reason it is two lots of £25.00.

 

By going over my overdraft in error i have incurred in one go 3 x 34.00 plus £50.00 and they refused a temporary increase in my overdraft although I have conducted my account well for some time.

 

I am still waiting for statements although they have cashed my cheque (from another another account- to show them I have a parachute account) just hope they are not using delaying tatics while waiting for a final ruling on the bank penalty legalities which is due this month.

 

I want to get started!

It's past 40 days for me today and still no list of charges. I'm giving them til Friday to account for postage but then will be getting in touch.

 

As for the charges, I didn't get the letter informing me of them at all, but then I'm not getting a lot from them lately...

 

I can't wait to get this money back off them, I'm just eager to know the total!

I checked my bank account and they waited almost 10 days to cash the bloody cheque, so the 40th day only came up on the 12th. But guess what? No statements!

 

Going to post the letter off from work tomorrow, I'm really annoyed it's gonna be 2 months on Monday since they actually had the SAR & cheque in their posession!

They've had more than long enough, noisypinkbubble, the 40 days starts when they receive the letter, not when they cash the cheque, (otherwise they could get away with never cashing the cheque!).

They definitely need chasing up on this one. :cool:

Thanks younganfree; I was sure I read somewhere it was 40 days from cheque but now I'm fuming. Can only print from work, but am filling the template in now and emailing to work. The buggers are just stalling I bet in case there's a ruling of some sort...

I am having probs getting my statements too. Someone called Chris at the Customer Relations Department said that he had been told they were about five days ahead issuing statements. Hmm that seems unlikely reading your story.

 

My 40 days are only up at the end of the week but they still have not cashed the cheque.

 

Hope you get yours soon...its really frustrating isn't it

Hi all!

 

I rang them up today to let them know I've posted the 7 day letter and they said "We haven't received your request yet"!!! I said "I'm sure you have, since you cashed my cheque on the 28th of January". The girl read through the notes on my account, realised they had and got very flustered, told me there was a backlog etc. I remained calm and was nice to her and said "That's all well and good, I appreciate that completely and I've given you more than a weeks good grace for postage etc; more like a fortnight actually, however if I dont receive them within 7 days I will be taking you to court as you have breached my rights under the DPA and by a large amount" She then emailed the team in charge and has let them know my letter should be with them any time, and I will keep a very close eye out.

 

I can't believe they just cashed the cheque then did nothing!

presumably they are so busy because so many of us are starting the process of claiming back our money - thats really good to know

Well I got my list of charges Saturday morning! So it really doesn't take them all that time, I'm just annoyed that they've stalled so much.

 

Busy is one thing, but breaking the DPA by a fortnight is something else - busy shouldn't mean comprimising a customers rights!

 

Anyway, its actually a bit less than I thought £953.50 (we've counted 3 times) so I'm filling the spreadsheet in now and getting the letters ready to print and post tomorrow at work. Ooh, things are finally going to start happening! I'm hoping for an early resolution since it's a relatively small amount compared to some :D

Hi, i'm starting a claim against this lot on behalf of my stepson.

I just wanted to point out that the pending OFT report should not make any of us panic or stop people from claiming their charges - they can only make recommendations. Only the courts can force the banks to comply.

Longleigh I agree completely. I work for a bank and have convinced at least 10 of my coworkers to claim back their charges (I haten to add, luckily none of us hold the accounts with our employer or that could become a sticky situation!)

 

I started typing up the spreadsheet and on rando play in WINAMP Meatloaf "Life is a Lemon" started playing; Meatloaf shouting "I want my money back" was strangely appropriate! :D

Well they never even responded to my prelim letter! DID manage to send me a letter telling me I could qualify for a loan or something though!

 

I sent my LBA on Monday, see if I get anything back from that. Didn't send it recorded though, just stuck it in with the work post.

Well thanks to some helpful advice in the general forum, I know I have to ring them first thing tomorrow and get the amount changed. Its gonna cost £35, but the interest is £133, so it's worth doing! *tries not to stress*

I got a letter from A&L today, dated 11th April, saying the fees were fair yadda yadda yadda, and enclosing the complaints leaflet. Hah!

 

**** on their bonfire when they get the stuff from the court, since I filed already!

 

Okay I did it wrong, but I'm posting my amendment form off tomorrow so yah booo sucks to the sweaty theiving barstewards!
