      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

At last - a reply!!! thank you, thank you!

 

ok - I have sent a letter to the bank, but I used a template letter from the 'money programme' website. I have had reply from the bank saying sos but are charges are justified blah, blah, blah. Luckily i have all my bank statements for last 6 years and so have started looking at them seriously!

 

I am now reading, calculating etc. etc. have requested a pack from the court and am now looking at sending my LBA to the bank and then going for it!

 

Have you claimed and where are you at? Any advice would be greatly received, especially on the 'interest' side of calculating!

Hi

I started my claim last April and it got settled in full in October, about 3 weeks before my Court date.

The only interest I claimed was the 8%, I didn't claim overdraft interest.

Good to know you won and got your money back!

 

A question, you said you did not claim the interest charges on your 'charges'.

 

Do you actually know how to claim/work out these? I have all my statements and was wondering if the 'interest charges' (not the 8% interest) were the amount that shows on your statement just above (or below) the actual 'charges' that are shown. If so, is this what I should be adding up and then claiming on the LBA letter? Hope this makes sense.

Hi

Right the interest I didn't claim was the overdraft interest, that shows on your statements. You can not claim all of these interest charges, only parts of it, you can use one of the spreadsheets that I gave you the link to above, to work out which part can be claimed. I didn't claim them because in my case I found it not worth the hassle to work it all out.

So if you manage to work it out correctly, you can put this amount on your LBA.

Does this make some sense??

Thanks Barty. It does make sense, I just thought it would be as simple as it looked! I may try giving the spreadsheet a go for these particular charges, but it seems unlikely.

Hi :)

 

Just to let you know that I am sending the LBA today (15/2/07), with the schedule of charges (without the 8% interest), a copy of their crappy letter and a copy of my original letter. I have since discovered I miscalculated the original sum, and so have mentioned this as a 'revised' calculation.

 

Will let you know what the reply is as soon as i get one.

Hi all!

 

Long time no speak! I just wanted to update everyone. I received a letter from the court and Lloyds are going to defend the claim - surprise surprise - is the defence they state the same for everyone i.e. is it the same word for word for me that they send to everybody who gets this far?! I now need to fill in the AQ form and may call upon your help!

Hello all!

 

quick update. I just dropped off my AQ to the court (along with attachements). I luckily did not have to pay the AQ fee as I qualified for an expemption! I await eagerly for the next stage. I presume I should start getting my papers ready?? What do you think?

Hi!

 

Can anyone help me??? I have had a letter from the SC&M. They say that the wish to settle. I have a few conditions. It says the letter is confidential - it is safe for me to list these conditions to you? The amount they offered, is exactly what I asked for, plus another £117 which I was not expecting! I will say that the main condition relates to having a review with the branch.

 

ANY advice greatly received!

Hi!

 

Just to let you know that I have sent/faxed to the letter SC&M rejecting their conditions. In the letter I copied and sent it says a bit about confidentiality. Has anybody had any feedback from this?

 

" I am also not prepared to agree to any confidentiality clauses you try to impose, unless of course your client wishes to make an offer of due consideration in addition to the amount of £xxx, in order to be afforded this privilege by myself "

Just interested.......

Still a waiting game.......I was going to call the solicitors to make sure they had the fax - what do u think????

Dear all

 

I have just checked my bank account and low and behold it has been credited with the full amount I was claiming! I am a bit confused - I have no letter to the reply of my 'rejection' and they have just decided to credit the account. I am not sure if I should accept this or do I need to write a letter to say that I accept the money, but only unconditionally?? or should a letter arrive soon? - Any advice?

Update:

 

Received letter from SM&C yesterday. They have confirmed the credit to my account and have replied "As agreed...." which I presume is the response to my letter......

 

"I accept your offer as full and final settlement only for this claim of bank charges made on my account between 9/11/01 and 9/2/07. However, I will only accept an unconditional offer and will therefore not be signing your acceptance agreement"

 

I will now be writing to the judge, confirming settlement.

I would just like to offer thanks to all those who have helped me......A donation will definately be winging it's way to you!!! Thank you, thank you , thank you!:D:p;):D:p;)
