In light of the recent posts by you can we assume that the banks are going to be defending the court actions in the very near future?

they have to defend 'the big claim' first, if its lost then thats the end of that. Sorry, thats not ment to dishearten anyone considering starting action.

 

you can be near sure that if you have already started with court proceedings that you will be in the system before the 'big claim', very unlikely that they do not defend.

 

if the big claim is won, they will be forced into changing the way of the penalties(big service fees). However the banks will not just pay back amounts of money if at all any just like that..... all this will have to be dealt with as and when it comes.

If Stephen's case is won then it will have a dramatic effect very quickly.

If the case is lost - it may not make much diffeence to anything. It will depend upon what the judge says about it.

 

If the decision is merely that Stephen hasn't made out his case that it will still leave things rather up in the air - rather as they are now.

Can you imagine a court making a decision that it was ok for a bank to bounce say 10 direct debits in a single day and charge £300 -£350 to cover costs? It's these automatically generated multiple charges that are blatantly flouting existing laws. They also use this same type of charging to get people into situations that they simply can't afford to get out of. Fixed income means charges maybe aren't paid on time, therefore impact on credit rating, therefore more borrowing at even more rip off rates etc etc. Some of the threads on this site have horrendous cases of banks trapping people who are most vulnerable and who can not afford to "escape". The banks know exactly what they are doing. If the banks do not behave in a fair and reasonable way, there will always be a case for taking them to court. :evil:

Well , my daughter is very determined, however I'm not sure she understands how intimidating the court environment is and I know the banks will have solicitors there who will run rings around her. It is very daunting.

I understand from someone who has taken a case to the small claims court that although she was very nervous to start with, the judge was helpful to both parties and the atmosphere was as relaxed as it could be and not at all intimidating. She won.

The law, in its majestic equality, forbids the rich as well as the poor to sleep under bridges, to beg in the streets, and to steal bread.

I am in the process of becoming a magistrate.

As I say to mates in the pub, you may not like what I say, but it will always be the truth as I see it.

Magistrates are told to rely on COMMON SENSE., to treat people fairly and not to be judgemental about the views of others.

Yes, but call me a fool, I have trust in the law, I really think that once my case gets heard a Judge, he/she will be independent enough to agree, and see the bank charges for what they really are. A profit making [problem].

 

Ps just had one of the banks defenses in, and as expected, they have indicated that because of the public importance of the case. They will be asking the court to move the case to the high court,

 

Sorry cannot say much more about there defence, part from it was nothing that I had not expected.
