....I can't find this on FAQ. I am intending to try to claim my bank charges and will apply to the bank for my six year's worth of charges in the morning. My question is, do I just go through the list and add up all the times I was charged £15/£20/£25 for returned cheques or exceeding my overdraft limit? Are there any charges I can't include (we have an Extra account and pay £10 a month which I know I don't include). If that's all I have to do then I expect it to be pretty high - charges in March alone were £105.

I'd go for gold and put the lot down, the banks have had it too good for too long. Don't let the swines get away with it. I wish I could claim, but they don't allow staff to claim charges back. :wink:

Hi kessik - welcome to the forums.

 

Claim only for the charges that were unlawfully added to your account. Any attempt to add on other items may result in a severe wrist slapping in court, if not worse.

 

 

amyjojo30 - I presume you have asked for permission to post here? Bank employees are certainly welcome, but they must seek permission to do so. Please contact our administrator 'dave'.

 

Also, please do not advise members to claim something to which they are not legally entitled.

Hey, thanks for such a quick reply! So, unlawful charges would be...where I'm charged £25 per day for each day I'm over my agreed overdraft limit and where I'm charged £30 for having a direct debit returned unpaid, right?

Exactly. Spend as much time as you can reading through the FAQ section - this is absolutely vital since you are now on the verge of taking legal action against a well funded financial institution...

 

You must not do so lightly, even if all the evidence we have suggests that it will be 'easy'.

 

Once you know this section inside-out, you will feel a lot more confident about the task ahead.

Hi

I have calculated how much I have paid in charges to Barclays over 6 years - £3125.00 - and am ready to write my preliminary approach for repayment letter. In the FAQ it tells us to send a schedule of charges with the letter and that there is a spreadsheet in the Library. I can see a spreadsheet for calculating 8% interest that I know I don't send yet so what is the schedule? Do I just type out all the dates I was charges om and the amounts or is it something else entirely? I didn't pay any additional overdraft interest over the years so I don't have to include that. Can someone help please?

Hi folks

You can see from my sig that I have three banks/bs all at the same stage (Barclays, Halifax CC and Sainsburys CC). My deadline to file a claim against each is 29/8. On Tuesday I got letters from all three offering 50% (Halifax and Sainsburys) and £1000 (Barclays against a claim of £3000+). I am inclined to ignore them all and press ahead to the MCOL stage next week. Has anyone else done this or should I accept their offers but carry on for the remainder - I intend to get all the money from everyone who has taken it from me. Will the court take a dim view of my not responding to the banks' letters or won't it make a difference? To be honest I can't be bothered with writing to accept half, working out the interest on the remainder and so on. So whaddya think?

I dont think it matters 100% if you dont respond as they have failed to do what you have asked of them, which is pay up in full. I sent a short letter along the lines of

 

Dear Mr Banker

 

Thank you for your offer of £xxxxx which I will accept at PARTIAL payment of the full settlement.

 

My total claim is £xxxx and I shall continue to persue the remaining amount.

I would respond with an accetance letter as pointed out, because if/when it goes through the courts you can claim that you have treid all reasonable constructive dialogue, to get this sorted.:) Good luck

No, I didn't send a schedule including the 8% to Barclays after I did MCOL. I don't remember seeing anywhere that I had to do that and I must've read this site tens of times. I thought I'd sent that with my LBA - that's what I did with the others I claimed against, all of whom paid up including the Court fee. Now you've confused me!

Print one out in that case and send it to:

Quote the reference number they have provided in their letters to you.

 

I would also send it recorded. It costs a pound but it needs a signature the other end. That's one less item they can add when they defend your Claim.

Thanks so far. Do I need to attach a copy of the spreadsheet including the 8% interest with my AQ when I take it to Southampton County Court (where my case has been transferred to)? I'm just confused because surely Barclays have a copy of this spreadsheet from my LBA so why do they say in their defence that I haven't provided particulars of the claim? Is this a recent thing that people send their 8% spreadshet to MCOL because I spent ages looking at this site, other threads, the FAQs before I did anything and I just don't remember seeing that anywhere and don't see how I could have done 4 MCOLs (3 successful so far) and missed that every time. I also don't remember seeing anything on MCOL when I filled in my claims. It's bugging me because I hate to think I've missed something out that might screw this one up - it's my biggest yet.

Can anyone tell me if I need to include in the correspondance part of my bundle copies of my original Moneyclaim and all the documents from the courts such as when it was moved to my local court etc or just my prelim letter, Barclays response, my LBA, Barclays response and their offer (of 1/4 of my claim) 'cos that's all I've got! Also, everyone else seems to have to get their bundle in 14 days before the court date but mine says within 21 days of service of the papers giving me the court date. Is this normal?

The letters between you and the bank will suffice. Courts do not seem to do things in a standard way. Some have an allocation hearing, others a directions hearing and quite honestly, I don't know the difference except that the Banks seem to settle before either hearing date. therefore, if the Court wants your bundle by a certain time then you must comply.
