Anyone out there knowledgable in buying Debt? I have the opportunity to buy a debt which I feel confident I can collect. I run a small business DCA amongst other things( all corporate business debts I might add before someone jumps on me :D nothing 'consumer' ). Trouble is there are legal goings on around the debt between the debtor and creditor and the debtor is threatening to sue for their legal costs to date. It is a Ltd company, B2B debt.

 

Question is, if I buy the debt do the legal costs to date come with it if we lost and are we just transfering the liability from their company to mine or does the previous contract end once I bought it?

 

Make sense? First time I have thought about doing it with a client.
