I am just about to start my claim against the Nationwide. I am putting the details of the charges into the spreadsheet and will then commence the action.

 

Anything I should know at all from anyone, all help would be greatly appreciated.

Hi the best advice I can give is to read! ;)

Start with the FAQS and step by step instructions also read some of the success threads in your bank forum.

Cheers!, right here goes with the preliminary letter tomorrow, so this goes off to Charles Bacon along with the schedule of charges that I'm claiming - just over £2000.

 

I'm right in thinking this should not include the 8% interest charge at this stage am I?

I am too starting to claim against Nationwide but for £110 being 3 bounced cheques at the exceeded o/d fee. I tried the nice approach but they sent me two letters saying basically no chance. I called them to discuss it but guess what.. they can't as the people who answer the phones don't have the authority. Today I sent them the first letter giving them 14 days to repay or I'll take them to court. Good luck!

We had a joint account but put the claim in only one name.

 

When you do your LBA they will say no and suggest you open an acount with another bank.

 

Go straight to MCOL like we did and they settled in 2 weeks.

Woolwich N1 issued 15.01.07 £11k

Acknowledged 01.02.07

Defence Filed 15.02.07

AQ Filed 21.02.07

AQ Deadline 05.03.07

Woolwich AQ late, given till 16.03.07

29.03.07, Judgement rec, woolwich to pay up by 10.04.07

Money received 16.04.07

 

Nationwide MCOL issued 22.01.07 £1k

Settled in full 05.02.07:D

Account being closed

Appeared on Watchdog 20.02.07

 

Abbey Issue MCOL £5k 24.01.07

Defence Filed 21.02.07

29.03.07, AQ hearing set for 20.04.07 with other like cases.

11.04.07, Full settlement letter received for £5,769.12

hi richard, i too am claiming from nationwide, and i sent my lba to electra house, kings park, not to Mr Bacon, it is when you go to court that you will correspond with him. hope this helps,

Hi yes follow the set proceedure, send the LBA . The 8% is added at the court stage.

Have U checked out threads telling U about successful Claims using Daily Compounded Contractual Interest @ 24.9% APR instead of s69 Statutory Interest @ 8%???

It can often double/treble your Claim amount, depending on how far back the unlawful Charges were debited from your account!!!

Here's a link to a very user-friendly spreadsheet (...courtesy of Mindzai).

Use V1.9 and just follow the instructions, enter your personal data and see for yourself!

Contractual Interest figures and the fact that U intend Claiming C.I. needs to be mentioned when U send off your Preliminary Letter!

U could always start the process again and re-send your Preliminary Letter adding an apology for your mistake and quote your NEW higher figures!

Just so I am totally clear, to claim s69 8% I don't mention it until I put the court claim in.

 

If I wanted to claim 24.9% I should have mentioned that I would be claiming CI in the preliminary letter and all correspondence thereafter. As I didn't I should rewrite the letter adding "I am also claiming CI at 24.9% being £xx"

I can't emphasise how important it is to FULLY research the WHOLE Re-claiming process BEFORE embarking out on it!

When U get a reply to your PL?

...Don't U mean IF??...lol

 

If U DO get a reply though, it will probably just be a standard "Fob off" letter.

The flavour of the month seems to be the one saying that "If U have a complaint, U can complain to the F.O."...or something very similar!

Nationwide will just try to confuse/slow U down/put U off.

If the letter doesn't offer U a FULL Settlement of the monies that U are claiming (...which is very, very, very, very doubtful!), ignore it and proceed to the next stage of sending them your LBA after the timescale U have previously allowed them to Settle your Claim with U.

 

I personally would send your LBA to the same address that U sent your PL to.

...Nationwide have an internal post system and it will get to the correct Dept eventually I'm sure!

The only address U will need to be precise about, will be Nationwide's Registered Address, when it comes to putting one down on your Claim Form for Filing @ Court.

Right, help needed!

 

I got a reply from NW, the usual bog off, you agreed when you opened the account etc etc

 

Do I ignore it and wait for the full 14 days before sending the LBA or should I send it sooner? The 14 days will be up on Friday, I know its only five days to wait but....................

What is there constructively, that U could say in reply to Nationwide's letter to U, to make them give U YOUR money back asap???...nuff said methinks!

 

14 Days is 14 Days I'm afraid.

...U would expect the same if U were the Defendant wouldn't U?

Just imagine what U would be saying in your Defence, if someone rushed into Court action against U!!!

 

Use the time researching the next few steps of the process.

Hi Richard P!

 

If in doubt, just err on the side of caution and date/send it on the 23rd Feb.

U wouldn't want your Claim thrown out of Court on a technicality of NOT giving Nationwide enough time to comply with your request to Re-pay U, and possibly have costs awarded against U, now would U??...lol
