    • In terms of "why didn't I make a claim" - well, that has to be understood in the context of the long-standing legal battle and all its permuations with the shark. In essence there was a repo and probable fire sale of the leasehold property - which would have led to me initiating the complaint/ claim v SPF in summer 19. But there was no quick sale. And battle commenced and it ain't done yet 5y later. A potential sale morphed into trying to do a debt deal and then into a full blown battle heading to trial - based on the shark deliberately racking up costs just so the ceo can keep the property for himself.  Along the way they have launched claims in 4 different counties -v- me - trying to get a backdoor B. (Haven't yet succeeded) Simultaneously I got dragged into a contentious forfeiture claim and then into a lease extension debacle - both of which lasted 3y. (I have an association with the freeholders and handled all that legal stuff too) I had some (friend paid for) legal support to begin with.  But mostly I have handled every thing alone.  The sheer weight of all the different cases has been pretty overwhelming. And tedious.  I'm battling an aggressive financial shark that has investors giving them 00s of millions. They've employed teams of expensive lawyers and barristers. And also got juniors doing the boring menial tasks. And, of course, in text book style they've delayed issues on purpose and then sent 000's of docs to read at the 11th hour. Which I not only boringly did read,  but also simultaneously filed for ease of reference later - which has come in very handy in speeding up collating legal bundles and being able to find evidence quickly.  It's also how I found out the damning stuff I could use -v- them.  Bottom line - I haven't really had a moment to breath for 5y. I've had to write a statement recently. And asked a clinic for advice. One of the volunteers asked how I got into this situation.  Which prompted me to say it all started when I got bad advice from a broker. Which kick-started me in to thinking I really should look into making some kind of formal complaint -v- the broker.  Which is where I am now.  Extenuating circumstances as to why I'm complaining so late.  But hopefully still in time ??

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

the point being that if you do read the T&Cs and then still apply, it is obvious to them that you do not know the relevant law. And that is why they pass people onto another scambag (probably a front for themselves anyway, who knows?) who scams for another £30

Having read Wentworths smallprint, it seems that after 6 months you can claim for your brokerage fee back, but they can keep £5 which I assume is satisfying the above law. I tried last month to reclaim my brokerage fee, after applying for a loan last year and (surprise, surprise) recieving a letter from Parkfield Financial Services Ltd. in association with Ralph Marlon Ltd. to whom I sent the details they asked for and recieved nothing, not even the return of my payslip or utility bill. A couple of weeks later I recieved a letter from Wentworth claiming to be a refund form needing proof of identity as "we have received a large number of fraudulant applications", but which looks more like an application for a loan, they even ask for a copy of a recent wage slip and utility bill for the refund. I haven't sent any of this off as paying the brokerage fee by debit card I don't believe it is necessary (the CAB confirmed this). It says in their small print also that they will refund the brokerage fee within 30 days. So a quick question, by thanking me for requesting a refund, are they confirming receipt of my refund application? In which case the 30 days should start from the date my letter was sent surely? And if they don't refund in this 30 day period what would be my next coarse of action? Many thanks in advance.

their Terms and Conditions are written in law - no company genuinely offering a broker service should ask for an upfront fee . What the law they sign up to to get a broker's licence state, is that it is only after 6 months of failure to find a customer a loan that suits can a company ask ask for a nominal £5 sum.

 

Any company that asks for and takes an upfront fee is contravening the law that relates to their having and keeping a licence, and The Office of Fair Trading as issuer of the licence can take Wentworth Finance licence off them.

 

Threaten Wentworth Finance with contesting their licence with The OFT and the speed of return of your money should rattle the bank vault doors.

 

If they took money from your account in a manner that was unexpected and surprised you (their usual trick) then they are contravening The Theft Act and could do up to 10 years in prison if you are willing to ask the Chief Constable of the area the head office is in to assist you in indicting them for contravention of The Theft Act.

 

Threatening them with this course of action forced the return of money to a previous victim who contacted me, a sum returned that included the bank charges suffered when he was thrown into overdraft with subsequent bank charges - the company had no option but to pay up or they would have been indicted, with the assistance of the Chief Constable of course.

Have today received a cheque for £50 from Wentworth as a refund to my broker fee, minus the £5 they are allowed to keep for being crap. Please anyone don't use this company any many thanks for the help.

they must have tried for 6 months to provide you with a suitable loan to be able to claim the nominal fee of £5 dictated by law.

 

They did not try - have you had any possibly acceptable offers? - and six months has not passed - theoretically they shouldstill be looking to fulfil your need, andvisibly so by providing offers from legitimate finance houses.

 

They are in business to take money wrongfully in a contravention of their licence conditions. A lot if they can getaway with it, but £5 will do if they cannot get away with it.

 

Ask them for your £5 back and which they can have returned after 6 months given offers are provided in the interim.

 

I think you should threaten their licence to get it!

obviously they haven't tried in the past 6 months to secure me a loan, so will be writing another letter to try and get my remaining £5 back.

I had the same experience with this company this week.Now they are changing their tactics and using your debit card details to make a point of sale transaction(POS) as this is not as easy to cancel like a direct debit.My bank told me they could only refer me to the fraud unit at the bank which means cancelling your card etc.I am disgusted they are doing this sort of thing-I am going to do everything in my power to get my money refunded(thanks to the great advice on here).

After going online to look for a loan ,loanfinder Uk kept coming up.I went through the form,foolishly giving my bank details,however I know that companies by law need your consent to take access your bank account.while on loanfinder I saw small print about fees and didnt complete the registration.I'm not daft and certaily didnt click on any button that authorised them to bill me.when I got paid the other day,luckily I saw they had set up a direct debit and tried to take £29 from my account.as it was a DD the bank cancelled it and they told me they are seeing more and more of this with these companies.wentworth phoned me the other day,said I was eligible for a loan etc,the interest rate was ok,and he needed my debit card details to "verify my address".He certainly didnt mention anything about money ,stupidly I gave him these details as I knew it was against the law to act fraudulently and not take money without my permission .however today I saw they had plundered my account with a POS transaction for £59-they obviously have changed tactics and know a POS transaction cant immediately be reversed- and out of a 100 people only a few might complain,they picked the worng person with me and I will ensure I get my money back AND SOME.they are parasites and shouldnt be trading.we have to do something about these companies and you probably now they are all connected.how many people have they robbed and got away with it??

This POS take puts this company and those like it in a new league - they are not just ignoring their licence conditions , but proving irrefutably that they are in this game for the [problem], and certainly not to become more and more competent brokers.

Hi guys,

 

I applied for a 3000 pound loan, a couple of days ago online, I got a phone call yesterday, saying I was successful, and I would have the money in my account in7/10 days. They also told be about the 59 pound brokers fee, which i did pay.

Am I correct in thinking this is a con, or has anyone actually received a loan off of them.

I am a tad worried now.

Did they tell you who the loan was with, how much the interest rate would be and have you had a copy of the loan agreement? If the answer to all these questions is no, then I suspect that the only money changing hands here will be the £59.

Im not sure if they mentioned a companys name, but they told me the APR was 15.2%, Im still waiting in the loan agreement. I got a letter off of them this morning wanting my bank details for the brokers fee, which i have sent away.

You could try telephoning them and asking who the loan is with and instructing them not to take any money from your account until you have seen a copy of the loan agreement.

 

The reality is though is that this company are [problem] merchants. They are on a par with the people who send out emails claiming that you have a large payment due to you that will be released when you pay some sort of fee.

I just called them there, and they told me that they couldnt tell me the loan companys name????????????? until they recieved the brokers fee.

 

In that case, call them back and tell them not to take the fee. Then follow this up with a recorded delivery letter telling them the same thing. They might do as you instruct but I wouldn't bet on it.

Just done that, they told me,that they cant tell me the companys name, incase I go to them and dont pay the brokers fee.

They havent taken any money out of my account yet. The only way i wont get a loan, is if, i have lied on my application. according to them.:confused:

OK, let's look at this in another way. Did you try applying for an unsecured loan with any of the mainstream providers? Were you turned down? How good is your credit?

 

my credit is poor, ive applied to a couple, Yes finance etc. I have been accepted but decided to leave it until now. I also have a payday loan.

high street banks wont give me loans, overdrafts etc.

In which case why is this company apparantly prepared to do so at an interest rate not much higher than the high street?

 

At the end of the day you stand to lose £5 as when the process falls apart with Wentworth they can keep this even if you manage to extract a refund from them. If you do choose to carry on, please report progress back here. I would like to be proved wrong and find that this company does provide a legitimate service.

if they have taken money without having first provided you with access to a loan on terms you find acceptable then their licence dictates that they cannot in six months time ask you for more than a nominal £5 - certainly not now, certainly not £59, and certainly not until you have agreed to the acceptable loan!

 

To say that they have a loan in mind for you as a means of your paying (quite wrongfully) them money is DECEPTION

 

Taking money from another by DECEPTION is a CONTRAVENTION of The Theft Act and punishable by up to 10 years in prison plus a fine.

 

I believe your simply mentioning the above two lines will get you your money back rather quickly.

 

If not, let the forum know, but also ask The Chief Constable responsible for the county in which Gravesend stands to help you indict for fraudulent theft.

I have fallen into the same trap as yourself. However, Wentworth have taken the £59 out of my account TWICE!!!!! ROBIN' BA****DS! :mad:

 

I am going to take ZipDee's advice and call them now. Thanks for posting the direct number - I called the 0844 number and was put on hold for over an hour until the queue got down to number 1 at which point I was cut off! :mad::mad::mad:

 

To anyone else reading this DO NOT, UNDER ANY CIRCUMSTANCES HAVE ANY DEALINGS WITH THIS FIRM. YOU HAVE BEEN WARNED!
