    • Perfect, thanks Dave.   You're right, a whole dodo storm this has been. As sons of first-generation immigrant parents, whenever something like this happens the old man panics. There was a whole "appeal this now" because my dad paid for the parking as he was with the hirer at the time and he isn't as tech-savvy as my brother so he ended up doing what he did and because I don't live there anymore it came all the way down to this.  But yes, we'll do this SAR and see what comes of it.  Will keep posting here with the hopes that it may benefit someone in the future.  Thanks again, everyone.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone,

 

First post, and although there's hundreds of other posts here, I'm not sure what to do next, so just after a little advice and support really.

 

I've got all my bank statements, highlighted all my charges, added them up and it comes to just shy of £4,000 (without interest).

 

But from reading in this forum, the Halifax seem to get quite awkward with any requests for reimbursement - how far do they take this before paying out anything?

 

And I've seen two versions of the claim letter - the one on the BBC News website doesn't mention claiming interest, but the one on this website does. Should I be claiming for interest from the start?

 

Also, the BBC website suggests sending the letter to your local branch, but a few people on here suggest sending the letter to Trinity Road - which is best?

 

Sorry to re-iterate old questions - I guess you don't feel right until you've asked them yourself.

I claimed £565 back from Halifax Card Services recently. In my case I received the settlement just after sending my LBA (letter before action).

 

I consider myself lucky, as most banks are waiting for litigation before settling. Then, you may have to wait for a defence to be entered, file an AQ (allocation questionnaire), get a court date and even submit your court bundle (evidence etc).

 

Stick to letter templates you find in the banking templates forum and try to avoid external site information. Although it may be correct, this is the tried and tested proceedure that wins each time.

 

The interest is not applicable until you start legal proceedings, and only when you fill in your claim forms should you ask for it.

 

You can send the letters to either Trinity Rd, or you local branch. Your local branch will ensure they are sent to the relevant departments. Ensure all posted documents are sent recorded delivery too so you can guarantee safe receipt of them.

Re posting, does Proof of Posting stand up in court? I thought it would have been necesary to prove delivery hence the advice on using Recorded Delivery.

I'm waiting 10 days into a Recorded Delivery on the hope it will still turn up.

If Proof of Posting is OK thats great as I can use the receipt from the Recorded Delivery.

Any ideas?

Hi gawuffy - good luck in your claim against the Halifax!!! I successfully claimed against the halifax with full settlement received in January. Have a look at my thread to see my timescales. One little tip -- go over all of your statements again - just in case you've missed any charges :D

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

Thanks to everyone who's replied, - that does make me feel a bit better about embarking on this - especially with jaxads' success story!

 

I've just had a final read through of the letter and my schedule of charges, and sent it at lunchtime - Recorded 1st class & signed for. Chances are it'll get to my branch tomorrow, so we'll see what happens next.

 

I'll keep everyone posted...

 

 

(by the way, what would you consider a "Returned Cheque" with a charge of £90 on my statement to be? £90 for bouncing a cheque?? Somebody had a nice Christmas on me didn't they! It's gone on the charges schedule anyway.. :rolleyes: )

Another update, Gawuffy fans. Recieved a letter this morning from my local branch (although the letterhead address is Leeds) with the standard repsonse:

 

 

Bank Charges

 

Thanks you for your letter dated 5th February 2007 concerning the charges on your account.

 

You will find enclosed a copy of our leaflet which tells you how we will handle your complaint. Also enclosed is a leaflet explaining our current bank charges.

 

I'm sorry you have found it necessary to contact us regarding charges applied to your account. I have referred the matter to Customer Relations who will investigate and be in touch as soon as possible, but at the latest within four weeks. In the meantime if you need any further help please contact me on 01691 xxxxxx.

 

Yours sincerely..

 

Enclosed are two leaflets - "Personal Customer Complaints - Here's what we'll do", and "Bank Accounts - Helping you to understand bank account charges".

 

Also note, the 'Thanks you' is their spelling mistake, not mine.;)

 

Let's see what happens next. Feeling much more upbeat about it all now I've had a response, and I know someone's read the letter.

Hey everyone, just a little update - we're well into the second week now - their 14 days is up on Monday, and I haven't heard anything since that last 'standard' letter.

 

Here's hoping for a reply in the next couple of days, otherwise we raise to DEFCON 2.

 

Has anyone else not recieved a reply within 14 days?

Hi,

I phoned the Halifax on Monday as my LBA expires on Friday this week but I was told that they're snowed under & are finding it hard to keep to their own timescales never mind the ones we set!! I told her I'll be entering the claim to Court on Monday & she said that I'd just have to do what I felt was right!! So, I've got until Mon. a.m. to hear from them.

Right, that's it. 14 days are up and no reply beyond the standard acknowledgement. I even waited home until the post came this morning just in case they were leaving it 'til the last minute.

 

LBA will be in the post tomorrow, but is it wise? A friend who works for Abbey advised me to give Halifax the full four weeks before threatening action.

 

I guess all the good people on here can't be wrong, and he'd had a pint or two when he told me. Aah to hell with them, let's get this LBA together! :o

This is the tried and tested way.

So send your lba today and the cahances are you wont get a reply, if not carry onto the next stage in 14 days.

Hi gareth,

 

Claim the interest from the start ...its likely to be as much again as your charges.

 

Use the spreadsheet template to work it out. Send your letters etc to Trinity Road to save time...your branch will only forward send it there anyway.

 

BOS do stall and delay but the Halifax seem to settle quicker. I'm just filing court forms (tomorrow) I expect them to pay up when they get a court date.

Righty, thanks again for the advice and support everyone, although I think I've made a mistake with my preliminary letter then:

 

The template for the prelim. letter includes

"I calculate that you have taken £xxxx.xx plus £yyy.yy which you have charged me in overdraft interest for the sum which you have taken. Total £zzzz.zz"

 

So using the spreadsheet, I filled in the figures from the sheet (£3,870.00 in charges, £503.40 in interest, making £4373.40 in total).

 

I'm due to send my LBA today - should I amend the figures on the LBA before I send it?

 

Sorry, - have gone through the instructions but it's still confusing me..

Hold that thought!

 

I still haven't sent my LBA (stupidly busy at work, but that's no excuse), BUT I've just checked my post, and I've recieved an offer!

 

I've been given a full and final offer of £2,588.00 - this is a lot higher than I was expecting, but obviously not the full £3,870.00.

 

I know it's frowned upon (in a nice way) to accept at this stage, but considering I'm over £500 overdrawn with a week 'til payday, I'm really very tempted. This would sort me out nicely (although I wouldn't be able to afford to retire - damn!).

 

There's a phone number for me to call and discuss things. I may give them a shout tomorrow and see if I can up the offer over the phone?

 

Advice or discouragement would be most welcome. Again, thanks to everyone who's chipped in and put up with my cowardice!
