      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there everyone i'm just wondering if i can start to make a claim even if i am still in my overdraft? The thing is, i practically live there :oops: . I've been reading thru the site and i've got a pretty good idea of what to do even thou i'm not the sharpest knife in the draw:oops: , but thats one thing i need clearing up please. Please help me, i want my money back but i'm gonna need a bit of guidence along the way from the more intellectual ones of you out there :p.

Also just one more thing does anyone think that the fact that i used to work for Lloyds TSB might complicate things or am i just as likely to get my money back as everyone else (I think i deserve it more after work for the thieveing b******S :-x for 3 years!!)

Yes you can begin when you have an overdraft. They can't treat you any differently because you used to work for them. There's another thread Can Lloyds Staff Claim Back Charges???? where somebody who recently left Lloyds is beginning the process. You might find it useful to follow.

Thank you very much for your help:oops: I'm very very grateful.

I have had a read thru that and i feel a lot happier now. I've been reading bits and pieces since thursday and i now feel ready to send off my prelim letter tomorrow, i'm thinking maybe send it courier thou so they have to sign for it?? should i use the gresham street address for my first letter??:oops: :oops:

 

Also can i run two claims simultaneously one for my bank account and one for my credit card??:oops:

That's ok. Send your first letter to:

This seems to be the main recovery centre that people deal with. If you receive a reply from either the recovery centre in Andover or Brighton then send your LBA to the new centre as they will have transferred your original letter to them.

 

Yes you can run two claim simultaneously.

Right, Deep breath then, i'll be a brave girl and i'm gonna do it, i'm gonna send my first letter tomorrow, requesting 790 quids worth of disgusting charges and then i'm gonna go thru my credit card statement tomorrow evening instead of going to the gym (one night wont hurt) and find how much they owe me from that!!

YAY!! I'm actually quite excited

OK I've done it :p I've sent my prelim letter today. Sent it by courier so they'll have to sign for it so they can't claim they never got it. I'm still quite nervous but keep reading bits on the site daily that are boosting my confidence.

Waiting in anticipation for my first response from them :oops:

Gotta start a load of claims for my boyfriend too tomorrow, i'll be an expert at this soon LOL

Hi Peeps,

Still no letter from Lloyds! One week and counting before i send my LBA. I konw they have had my letter coz i sent it courier and they have confirmed that it was signed for on the wednesday morning at 8:38am (too early for me :p) .

 

I do have one question thou please if someone can help?

Is it the same procedure to claim back from my credit card or does it differ??

I will be sending an SAR for my credit card tomorrow then as i don't have my statements for that.

If i don't receive any response at all to my prelim letter that i issued last week on my bank account within 14 days do i just go ahead and send the LBA?

I was quite excited when i got home last night and found a lloyds tsb envelope on the mat (sad arent i) thought it would be my very own "sod off letter" but unfortunatly it was just a statement (no charges this month thou)

We have to agree to make the payment by setting up or increasing and overdraft, or tell customers we can't agree it. We feel it's fair to charge for this service.

 

Of course it's only fair too, that we're completely open about any charged-for services before you take them up. That's why we take care to give every new customers the latest guide to our charges. You can also get up-to-date details about fees and borrowing rates at all our branches, through our helpline and on our website.

 

Just as importantly, we do everything we can to help our customers avoid these charges altogether. I'm sure you'll know how easy it is to keep a running check on how much is in your account. You're free to get an up-to-date balance at any of our cash machines, over the phone, on line and by weekly text to your mobile. If you know a payment is going to take you over the limit we've agreed, you're welcome to see if we can raise it - and we can usually give you an answer straight away. Again we can do that for you by phone, on line or at any of our branches.

 

You've mentioned the new guidelines from the Office of Fair Trading on credit card default charges. We don't agree with the OFT's thinking on this and we're still talking it through with them. But the important point is that the guidelines are about 'default' charges that people pay when they break an agreement with us. The fees we charge for dealing with your request to go over your agreed overdraft limit are not default charges because you haven't broken yur agreement. They are our prices for the services we provide in these situations.

 

I do hope you can see that we make our charging system as fair as possible - and why i can't agree to cancel your charges.

 

Please let me know if there is anything else i can do. If we cannot come to an agreed solution after this i will help you refer your complaint to the Financial Ombudsman Service for independant advice.

 

If you are happy with the way i have dealt with your complaint, there is no need to reply to my letter. If i have not heard back from you by the 09/04/2007, i will close my file, though I will be happy to reopen it should you come back at any point aftrewards.

I laughed so loud when i got it, its an exact replica of so many other peoples responses and once any fails to provide any information as to exactly why they are charging so much for these "sevices". HE HE

 

Will be sending my LBA today, can someone tell me if i address this directly to Debbie Gilbert (I actually feel quite sorry for her, having worked for LLoyds myself) at the Andover address or stick to the one i used for my prelim letter? I think it is the former but just double checking, if someone can help please?

I'm going to start familiarising myself with the court bits and pieces over the weekend, done the speadsheet with interest to go with the N1 but can't seem to upload the court bundle info, think its because we run Linux here instead of Windows, so i'll have to pop over my mum's while she's away and abuse the facilities there.

Thanks, just had a read thru it. Sounds like they gave you quite a run around with the SAR. Luckily i got my statements on line so i didn't have to go thru that :p. But i am sending one for my credit card, having read you thread i think i'm going to have to be one of those "pain in the backside customers" and phone every week to see how they're getting on with it LOL!!!

Where did you look to find your local court?

Well......i just googled 'County Courts' and one of the sites gave me a drop down menu to choose my local court. However, most of my local courts are Magistrates Courts not County Courts. Got to go further afield for one of them (dunno if a magistrates court can deal with my claim

Hmmm i just tried that and my local one comes up as a "Combined court", sorry to ask the obvious but does this mean it is both a county court and a magistrates?

I hope so coz that ones only round the corner from where i live.

 

Does anyone also know, if i do actually have to go to court (which i'm quite happy to do) can i take someone with me?
