I would suggest to any one new too this forum, that they send reply in early stages by recorded post and keep copies, it shows that you are following your duty as a responsible person. It doesn`t matter if you were the driver or not, a photo is not proof that any law has been broken. After that ask for proof that they must declare for any legal battle to commence, (remember a photo is not proof). Then write cease or desist again by recorded & leave the rest to them, they will go away eventually!!!!

Hello everyone am new here and well came upon this site from typing in UKPC to see what i got and well i am shocked to read so many stories.

 

Anyway we recieved a CHARGE CERTIFICATE- FINAL REMINDER. We never even got the parking ticket issued on the vehicle or even a reminder that one had been issued. They are demanding £90. Apparently it is issued for Unauthorised parking in station shopping court, Reading if anyone knows this place? My OH is stating that it said 3 hours free parking we live miles from reading so if anyone knows what it says on there parking signs would u kindly let me know. anyway just wanted to know what we should do? do we have to pay it or should we write to them? And any template letters that we could use?

You're near the end of the process now - ie. when they give up.

 

Issuing paperwork entitled 'Charge Certificate' and therefore imitating the council process is probably an offence under the 2006 Fraud Act. They know this, so will never ever take you to court.

I concur, there is no record of UKPC issuing small claims, even less likely when they have no idea who was driving. Keep mum and they will give up.

If this is on private property or land that UKPC are operating, then there so called rules or contract whatever can only be viewed as advisory, there is no law to back them, that`s why they don`t go to tribuneral or court, they just hope to find someone who is either frightened, gullible or shall we say lacking on the knowledge side to pay them, PAY NOTHING!!!!

Because they have no legal backing, they will stoop to breaking OFT guidelines etc

Today i got another final demand from a company called Churchill's. so we have shifted companies from UKPC to Rossendales to Churchill's. i believe that they are closely associated with UKPC from previous posts... i'm not sure. dose any reader have more info on Churchill's?

 

to the previous poster who is looking for letters... you wecome to use what you like from mine... it is pretty much constructed after looking at simular letters on this site. but i can't vouch for it's effectiveness... other than the fact that the companies have tottaly ignored my serious attempts at comunication which convinces me of how they simply want to threaten you rather than engage with you. i dont think any letter will end the situation quickly.

my letter is also from Churchill Recovery solutions, so called professional debt collectors, but if you look at footing of letter its from Rossendales collect ltd, obviously just another front from them. Rossendales, churchill whoever bring it on bunch of parasites.

Many Thanks Tony49 So it is! I should look a little closer at these things before i post. obviously this is part of their tactics to blur the details, for while there i thought i was going to have to send another letter to another company. well that saves me the 80p for recorded delivery.

I have to say that i`m surprised or maybe not, at Rossendales taking on these so called debts for UKPC, or any other PPC fully knowing they are in dispute, then they to break the guidelines and put there own co. at risk

my daughter is a top lawyer within the magic circle as they call it and has told me that if it gets out of hand then, she will pass this onto one of her colleagues who specialises in the appropriate law, it could even mean charges being made against UKPC. They have alot to answer for, breaking recognised acts, guidelines etc Oh & when they lose the case, the costs to them could be the end of their practise for good. So in all I hope it does go to court. After all I feel sorry for the vulnerable who are at the hands of these crooks, parasites. They have alot to answer too!!

It seems we dont get many comments from the UKPC trolls lately!!!

Yes exactly, I thought about writing to UKPC with the idea of giving them 7 days to cancel my case or I will put it into the hands of a top proffessional lawyer, with counter claims & charges made against them backed by correct statuate law and in the correct procedure. But on the other hand as they seem to like to play games with people, it would be better to fight this all the way knowing that it could put an end to these PPC`s. After all it would do everyone a favour who has fallen foul to these Co.s

I havn`t as yet used the fact of my contacts in my appeal, but it would be a lovely surprise for them to turn up at court with either themselves being represented or Rossendales, it wouldn`t matter a jot to me!

UKPC don't take people to court do they so there is zero chance of them opening that door.

there are other PPCs that do like to take people to court through MCOL but that is civil.

Best chance is to go on the offensive isn't it ?

No UKPC don`t take people to court, I don`t know of any cases but the letter from Rossendales / churchill have sent letter threatening court on behalf of their client UKPC, "TO PREVENT THIS MATTER PROCEEDING TO COURT YOU SHOULD MAKE PAYMENT IN FULL NOW", but again I don`t think it will happen if they have half a brain, I think the idea is to pressure you into either paying or have the fat heads come around to pester you But still keep increasing the costs!!

Is there anyone out there in this forum who is further down the line with Rossendales or are being taken to court by them, it would be nice to hear from you and where you are at!

they won't take you to court if you have been firm with them or have just not responded. To my recollection the rare court cases only happen when the PPC thinks it has landed a nervous victim who will not defend.

Some PPCs much more likely to do that than others.

do NOT contact them.

read the PPC stickies and then come back with your new more informed opinion and ask the questions you see as relevant in the light of your new knowledge.

Why have so many of us received the same letter suddenly?

 

I know they are running a [problem], but still there is a little part of me that is a bit scared if they take me to court...

I would send a letter to Churchill stating that the so called 'debt' is in dispute therefore please pass back to UKPC. At least you will have set out your position. Anything further ignore unless they actually get to issue properly authorised court papers, which would be highly unlikley.

Did your letter say "You have failed to respond to our previous letter" Knowing full well that no previous letter was even sent by them. I think its easy to say that these debt Co.s and PPC`s would never work via sorting out any problems by the modern method of email, as a trace of proof would be had, but by this method, they can get away with it, and if it ever went to court, would simply get letter printed off with earlier date to make you look irresponsible!

Just simply "A BUNCH OF CROOKS"
