      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys, been reading through all the gubbins on the site and have now handed my Data Request into the BOS headquarters at the mound in Edinburgh. Hopefully will get a my statements sooner rather than later.

I opened my account in 1989 with BOS, how far back are we allowed to claim?

Depends, 5 years if it's in the Scottish courts, 6 in the English. Your decision may also need to take in to account your claim amount as small claims in Scotland is only £750 or £1500 for a summary judgement. It's £5000 down south. If you get as far as court then you can claim interest.

 

Read around the threads for someone whose case is similar and ask for advice, everybody has been at the same stage as you. All I'm sure will be pleased to help.

Ok, do you live in Scotland?

 

If yes then do you have relatives or friends in England?

 

I ask this because of the limits on small claims, my claim is under the 5k mark and since I dont fancy spliting my claim into serveral claims to go through the scottish courts I will be using a friends address down south.

If you receive, like some, an offer of a full refund at this stage I would bite their hands off taking it. But it's your choice as the interest accrued over 5-6 years as I've seen from my statements isn't small change.

I handed my SAR in to the head office in person, the receptionist wouldn't give me a receipt for it. Can I just phone customer services on monday to check its been received or should I just send another one recorded delivery and cancel the first cheque?

no don't worry about it, remember, 40 days. You may want to chase it up in a couple of weeks. Prompt them that the have only 14 days left to comply etc. It got where it needed to, just remember alll those thousands of others that arrived the same week! Makes me feel all warm and fuzzy inside. There's a lot of waiting involved, just be patient, stick to the timetable and you WILL get paid.

All you can do is phone and check, worst case you lose a week and need a new SAR.

Received statements today, noticed that there is "availability fees" of £24 in places. Any thoughts?

 

Going to send off my prelim letter asking for £7560 going back 6 years, if they refuse then I'll be going for the £5000 through the english court system then I'll get the rest later.

Hi Rooney, I issued a MCOL against BOS and as you said I was expecting to have to shave it down to 5K but when I got into the system it allows any ammount up to ....£99999!!! don't know why but I issued them £7864.02 made up of £6065 charges and £1549.02 interest with a £250 court charge. Got a letter back from court stating court sent claim to defendant 1st class post on 2nd March , deemed to be served on 7th March and BOS has till 21st March to reply. Oh shit I hope I win. Got one lined up for Halifax @ 3K just pausing to see how this one goes.

Thanks, my domicile is in scotland but my claim is for £7560. I have the use of an english address so will I have to register on mcol with the english address?
