      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well today I receieved the standard 'we're sorry you're unhappy' letter from the Halifax together with a lovely leaflet. Sorry Halifax we're working on my timescale not yours :D

 

LBA due to be sent on the 18th April......we count bank holidays and weekends in the 14 days...don't we?

Hi Sea-side lady

 

Thanks for your quick reply. I'm just thinking ahead here. Would you recommend MCOL or N1? All the particulars I've put on my statement of charges are 'charges as notified'. Also is it better to fill out the N1 form online and print it off or go to my local court to pick one up? Any suggestions on the best way forward now would be greatly appreciated. Also it would be useful to have someone check my handywork on the form filling side ( if that's possible ). I just want to get it right and not provide any reasons for my claim being rejected.

Thanks again Sea-side lady for that. Having read all that I'm tempted to favour going down the N1 route. One thing does concern me however and that is that on my spreadsheet of charges I've just put 'charges as notified'.....is there a danger that this is too vague? The reason I put this is that this was what was recorded on the bank statements.

 

 

Can I pick up an N1 form from my local county court or shall I just fill in the 2 page one online then print it off. I'm querying this because it doesn't seem to contain much and what do you put at the bottom of page 2 where it talks about solictors etc

I did N1, and all i put was "charges as notified".

 

It is all they put, so that is the only thing you can put.

 

You can pick up the forms at the local court, i did, but my com was playing up at the time. You can download it from the letter templates.

You dont need to put anything for the solicitor. You didnt use one.

And take 3 copies of everything with you and they sort it all out and send where ever they need to go. They should also double check it for you.

So LBA and schedule typed up and ready to send off recorded delivery in the morning. I've included a telephone number just in case Halifax want to make me an offer of the full amount.....no, no, don't laugh, they may do :D

 

Just in case I'll get my N1 sorted.....only 14 more days to go ;)

I've just been looking at the pdf N1 form to see what needs to go where. On the back of the form is says particulars of claim attached...does this mean I can't type in my particulars of claim on the actual form?

 

Also do i just hand in 1 N1 form to the court but with 3x poc and 3 x spreadsheets?

 

Any advice gratefully received...just want to get it right first time, that's why I'm querying this.

Hand in 3 N1 sheets. with the poc and spread sheets attatched.

Well I popped to the local court yesterday and a nice lady gave me a court pack which included 3 N1 forms and lots of other useful information. She also said she would check it for me when I hand it in on Tuesday. I've heard nothing from the Halifax...so looks like I'm claiming an extra £500 interest :D
