      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Everyone

 

I'm itching to get started on my claim against the Halifax. I've printed off my SAR ready to send off, however before I do I need to check 2 things.

 

a) Will they close my account ( I have a parachute account set up in readiness)?

 

b) Will they withdraw my overdraft? I can't afford to clear it in one go. Would I be able to pay it off in chunks?

 

Should I send my SAR off and see what happens, can anyone advise.

a) Will they close my account ( I have a parachute account set up in readiness)?

I claimed on two accounts with the Halifax - one had been closed about 3 years ago (I closed it) and the other remained open. They did not close that remaining account and in fact sent me out a new card etc... but you do have a parachute account should anything happen.

 

b) Will they withdraw my overdraft? I can't afford to clear it in one go. Would I be able to pay it off in chunks?

I had an overdraft with another bank that I claimed off and they did not withdraw that facility. This however is a difficult question to answer some do some don't.

 

Should I send my SAR off and see what happens, can anyone advise.

First of all welcome and in answer to the above I have put my responses in red. Send off your SAR they have 40 days to comply from they date they received it (allow 2 days from date of posting). Send all correspondence recorded delivery that way you always have proof of sending and receiving. Then sit back and read The FAQ's plus similar threads on the Halifax site.

I know there is probably some information on the site already but does anyone know how much I would have to pay to file a claim at court (assuming it's under £5000). The pennies are a bit tight and I may have to borrow it if it's a lot. ;)

Depends on how much you are claiming. If you go on the MCOL site - link in the library, they tell you how much per claim etc.

it is really unusual for them to do this. I have an overdraft and cheque account and i recieved my new card today, so as far as i know they are fine.

I wouldnt fret over that yet.

Re the overdraft thing, I'm kinda hoping they DO take mine away so I can start from zero again. It would suck having that £750 basically wiped off my total that I'm reclaiming, but at least it would be out of the way.

 

Then its on to Egg, Halifax CC, Barclaycard, GE Capital....! Man, I've sucked with money for way too long :(

They will prob take up to the 40 days. If you get them before it is a bonus.

The waiting is the worst part.

 

The best thing to do is to read up on the next bit and have a play around with the spread sheets so you will be ready when you finally get them.

Well Hooray Statements received today in rather dishevelled and ripped envelopes. Time to get the ruler and highlighter out and look for those 'charges as notified' I think I'll use the simple excel spreadsheet as I'm not very spreadsheet literate.

 

 

So........onto the next stage..let the fun begin :-D

Well got the 'Completion of Request For a List of Transactions and Charges' letter today....standard letter thanking us for our request blah blah.

 

Prelim letter to be sent recorded delivery on monday together with spreadsheet of charges .....£2000 quids worth...wow amazing how it mounts up eh.
