Good luck.... I'm still at the SAR stage with Halifax but they haven't responded to any of my requests. They exceeded the 40 days as well as the extra 7 days so I reported them to Information Commissioner. That's before they contacted me about putting money into my account. I'm further ahead with another bank and they only contacted me was to say I did not send them £5 to get my data!!!! Typcal! But I don't care, i'm sticking to my deadlines regardless.

marcelle have you started court proceedings against them too? they have to get my statements to me before monday evening! i have typed my court letter out already in preperation to send it out quickly.

Hi all

I have just submitted my N1 claim form to the courts on 8th Feb, still waiting to hear back from them though dont understand why they are taking so long.

 

Anyway my account with Halifax is currently overdrawn by at least £5000 due to a chq i paid in for a car i sold, and later after i already spent some they told me it was a fraudulent chq. The account was then closed eventually and sent to debt collectors. I refuse to pay as i asked before i deposited the chq if it is ok and i was told yes.

 

My question is will they pay up because of this, and if so will i receive payment by chq like i asked for on my N1 or will they try to keep the money even though the account is closed?

Well the amount i am trying to claim is £1971.07 but since the account is overdrawn by about £5000 i thought they would just keep the money.

 

How has your claim been going? I didnt even receive replies to my prelim and lba. Not even a standard letter.:mad:

I am not at all sure that you would get your charges in the form of a cheque. I sympathise with that cheque 'bouncing' but IMHO the Halifax can keep any charges you will be awarded as the amount you will owe them exceeds any claim of yours. Back in a bit. Going to look for a thread. Sally

Hi

Just going through my files and realised that all the duplicate statements halifax sent me have the same old address on them. The fact that i lived in London when i opened the account makes me wonder why they all say i lived in Coventry. They know i moved address quite a few times. Now i am wondering if they have been altering my statements to suit them. But i do not have any of the originals anymore as the account is closed. I have already done N1 which was deemed to be served on 18th. Does anyone think i should give them a call asking why the statements are like that and tell them i will also be telling the courts about this, i was wondering if it would hurry them up with my payment.

 

Any thoughts?

As long as the figures are correct I cant see its much of a problem, you can always ring them and ask why. It may be that when they are reproduced they use the current address.

Also please stick to one thread for this claim you have 7 at the moment I shall get them merged. Thank you.:)

Don't worry the statements have not been altered - can you imagine them doing that and you then find the same statement in paper form but altered. That is a criminal offence under data protection act.

 

Simple fact is that every time you move your address is changed for all HBOS accounts and when they reproduce your statements it is all done from the main computer - where your address has already been changed. They are not copying a paper statement held on file somewhere.

Yes but the address they used was my second since opening the account, they sent me statements to 2 other addresses after that one. I was told they are duplicate statements and the address should be the same on the originals. Plus there was a chq paid in which after a mth they told me was a fake chq and took all my money in the account. But on this statement they have made it look like the chq was returned the next day and i continued to spend money afterwards therefore making myself overdrawn. This is not how it happened.

Hi everyone

Just got a letter from HBOS dated yesterday saying that they cannot find anything regarding my account as i forgot to put my account details on my claim so please can i submit my sort code etc:) hahaha.

Obviously its already on the N1 where it says the claimant had an account where i then put my account number. Plus the spreadsheet of charges which has my sort code and account number on it.

 

I just called to speak to the person who sent the letter, obviously they were not in today lol So i spoke to the receptionist i told her i would not be submitting anything again as i have a copy and the court has a copy and you can see it very clearly. They have until the 5th of March for me to receive my chq or i will be taking the next step Judgement.

 

 

spoke to them again and have been told they have until 12th March but as far as i aware they have not submitted a defence so do i just go ahead and do the judgement?

 

Also they have yet to explained to me why my so called duplicate statements all have the wrong address on them and how come after the account was closed in 2005 they have continued to charge over 2006?

I'm with you. They have all info necessary so why the delaying tactics? Perhaps they should take on more staff - or even cheaper, just settle. Too bad for them they are talking to a lady who has her facts straight. Sally

Hi all

Well halifax had until tomorrow to reply to N1 which they have not done so i am about to fill in the judgement form but require a little help with it.

 

Firstly i want my payment by chq so can i tick the part where it says i want payment immediately and just write by chq next to it? Although i did say chq on the N1 i dont want the halifax to try and be clever and put the money in my closed account.

 

Then the interest part, where it says interest from the date of claim(if any) what do i put?

 

Then it says period from - to, dont know what to write there

 

Rate?

 

Any help would be appreciated

Thinking of giving the bank 7 more days to pay up as they seem to think they have until 12th March anyway.

 

Have got this letter which i will send tomorrow morning recorded delivery and also email to the lady that last wrote to me. Please can someone have a look at this and let me know if it is ok. Thanks

Also I am still awaiting a proper explanation as to why my “duplicate” statements have the wrong addresses on them, incorrect entries and why I was still being charged in 2006 when the account was closed in 2005. If I do not get this information with my cheque I will be taking the statements to the court with me as I see it as an illegal matter.

First two paragraphs are fine, not sure why you're adding the final paragraph to this letter though.

 

I would suggest if you want to address the matter of the statements it requires a separate letter.

I agree it is probably better seperately addressed. Please stick to one thread for this claim you have 2 this makes it difficule to follow.

Got a call from halifax today saying that my case is being looked into haha well done to them what to they want a blue peter badge. Anyway i sent them a letter this morning recorded delivery giving them till the 12th march to pay up before i go for judgment. Lets see what they say to that then.
