      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

By the way, about this "Without Prejudice" thing : If A&L/Wragge put it on one of their offer letters and we write back declining without putting it on our letter, presumably we can then put our reply in the bundle can't we?

 

When I prepared my bundle, I didn't know anything about Without Prejudice and included everything:rolleyes: Oh well, the judge will just have to ignore it ... (you live and learn!).

thanks everybody for your support. Just been out for a night with "the girls" .few drinks and they went in a hot tub - but I had a bit of a wobbly about being old and wobbly:D and did not go in.:(

 

I am ready for the hearing and suprised it is so soon. Out in the sticks here the courts must be quieter???

 

I just keep thinking the worse that can happen is that I loose. not the end of the world!!! worse things happen at sea. (as spongebob knows!)

 

but here is my chance to pretend I am in the job I always wanted to do - be a barrister (sort of:rolleyes: )

Just to let you know Jan, when we were at court we asked the usher how things were going to go for the day, he went and got a solicitor brought him over to us and said give these guys some free legal advice :eek:

Anyways the sol said to take absolutely no notice of the rep from A&L and there was no way we were going to lose :eek: . He had a few clients there all claiming and he said hed done quite a lot over the last couple of months and not lost 1 !

Jansus you'll be fine. We're all rooting for you and I'm sure your bundle will be tip top:D. It may not even get that far, but if it does you can go do your Ally McBeal on their bottoms.

all with cossies- actually after a few drinks it looked like fun. We normally go to kareoke once a month - so it made a change. Also learnt lots about internet dating as two of them are newly single and although in their 40s and 50s are re-visiting their teenage years - with much younger guys:eek:

Just noticed something very interesting - researching a current account for my son and looked at the A&L premier21 account- guess what the daily charge for an unauthorised OD is ??? £25.00 -NO £12.00?? NO

 

£3.00 per day!!

 

So that surely shows that their admin is minimal. I know they are trying to attact new business but surely that shows the excess that we all knew we had been paying for years is unjustified. ( as if we did not know that already:rolleyes: )

you can tell its been a lovely day today - very quiet on here!

Managed to shut my eyes to all the mess and get out in the sun.

 

Last night my daughters lovely studious inoffensive boyfriend and a mate got beat up by a gang of 20 trouble makers at a village folk/rock festival!my daughter is still in shock and the two boys ended up in hospital.luckily they are out today - but i just know in my bones - the **** will get away with it.made me wish I had done something more in my life so that I could help stop people like this ruining the reputation of all young people- who are not all bad. bring back stop and search I say! (they were tooled up with baseball bats and crowbars).

 

 

feel better now i have had a rant.

 

 

must start my bundle soon!

Oh dear jan

 

my heart goes out to your daughters boyfriend and friend.

 

makes me feel quite ill thinking about it.

 

why are there so many nasty people out there.

 

Whenever my two go out -

I'm literally on tenterhooks until they're

back home and tucked up in bed.

 

I really don't understand the world we are living in today.

I dread hearing the news when the tv gets switched on.

 

We appear to be experiencing a breakdown in society.

with a large number of young people running riot,

where have all the moral values gone.

 

Good to hear they are both out of hospital today.

its really going to knock their confidence.

Poor things.

Give them my love and a big hug

and a hug and kiss to your daughter too.

 

Thankfully Jan,

there are, I believe

far more good people than bad people !

Bring back national service i say, the punishment for kids who are on a bad path is nothing. When i was very heavily pregnant i was mugged by a 13 yr old, he didnt get anything cos of his age. when he was 14 he burnt down our local school and only got 3 mths...ridiculous.

It appears these young kids actually know their rights

they know they can get away with behaving badly because of their age.

 

god only knows what kind of home life they have -

or more to the point don't have.
