Just to keep you up to date, I spoke to a nice lady today at Haliprats.

I explained that the offer they sent last week was short of £150 of the full asking amount of claims.

She said no problem we'll add this on & pay you the Full asking amount, No problem!!

So i'm having a good morning so far!

Won't get too excited 'till i see the money in the bank.

Well it's been a while.

They have finally paid up all the charges.

It's paid for the overdraft & now i have no pennys left.

A letter arrived from them last week.

The account is in joint names & the letter advised us to withdraw any money left over.

My partner opened this, & even though I did not see the letter, into the local branch she went & withdrew what was left.

She was told they had to keep the letter & advised her to go to the main branch & close the account.

We have also received a letter from their solicitors (debt department) telling me that I MUST CLOSE the account!

Have I been Conned?

Is this legal ??

They are not actually allowed to close accounts as a retaliatry action to a complaint,

The Financial Ombudsman Service has issued a ruling which implies that banks which close the accounts of individuals who have questioned charges to them by their banks have acted improperly. The FOS, which is an independent arbitration service, has told Alliance & Leicester that it has to pay a customer whose account it closed without notice after the customer took the bank to court over what he felt were illegal charges by the bank.

Even though this case was for alliance and leiecester you can use it as an example to the bank. on the FSA website, it states that banks do resrve the right to close accounts, but this should not be in retaliation to a complaint and they will investigate anyone whose account has been closed because of this.

I would phone the bank, use the allience and leicester case as an example, and comfirm to them that you will submit a complaint to the Financial ombudsman service. this make make them stop, if it doesnt make sure you do complain. Bookworm also has some details of account closure for halifax in his threads. i will try and find a link for you
