I complained about my additions account opened in 1999 and said I had never asked for it to be opened I got a letter today saying they have refunded 1 year as a goodwill gesture!!!

 

im off to the Branch asap has anyone else heard of this??

Got home tonight and have recieved a standard letter offering me £1125.00 my claim is for £2050.

 

Obviously I am not accpeting it but there is no acknowledgement of my court claim.

 

What do I do......?

Got letter today from court (acknowledgement of service) stating that Barclays admit to my claim....

 

Is it time to party? or not :roll:

Admit to claim!!

 

Thats a win for sure!

 

I have heard of them defending but not admitting to date.

 

Well done as admittance is what is sough and lets hope its a pattern now that they will stick to.

So, if they have admitted in full .......

 

If the defendant admits the claim but fails to make an offer of payment you are entitled to enter judgment against the defendant by default

 

Please note: you may not request judgment by admisssion if the defendant has not provided you with a written statement to say that he is fully admitting the claim. To qualify as a full admission, the defendant must have ticked the box "I admit the full amount" and signed the statement of truth on the reverse.

 

If this is so! Its all over......and you won!

I will only be happy when the money is in my account!!! im away working until tomorrow so cant get to the court until then...

They have definetly ticked the admit the claim box! have got until the 10th May they I can apply for judgement..

 

I know it sounds strange I was not expecting it myself even the lady in the court had to read it and then show it to her colleague.

very interesting, if they are admitting to your claim, then surely that sets a president for every other claim that has been submitted.

As we have all made the same claims, they surely can not admit to one and none of the others, as they all say the same thing.

Let us know what happens, because surley we can use your case to justify our cases.

Anyone out there who understands the implications of this to everyone else ?????????????????????????????????????

Caz i was thinking the same thing .... if they had admitted to 1 claim then surely it would be the same for all cases ..... I think some poor over worked employee has made a big boo boo here and ticked the wrong box ..... but im sure we must be able to use this to our advantage :D;)

where is dar£n when you need him, he would know the answer to this one, I am sure this is very important, and someone should know the implications of this, as surely they can not dispute on one case and admit it is wrong to overcharge on another one.

Help someone in the know !!!!!!!!!!!!!!!:eek:

If your claim is for an unspecified amount of money, the defendant will send a Form N9C (admission form) to the court. This is called 'admitting liability' (responsibility) for payment.

If the court served your claim form, the date by which the admission form must be sent to the court ('filed'), will be shown in Form N205B (notice of issue) given, or sent, to you by the court when your claim was issued.

The court will send you a copy of the admission form and Form N226 (notice of admission). The defendant may:

  • admit liability for your claim without saying how much is admitted; or
  • admit liability for your claim and offer a sum of money in satisfaction; or
  • admit liability for your claim, offer a sum of money in satisfaction and ask to pay that sum by instalments or at a future date.

As dicky says, this will not set a std for future claims, as each claim is dealt with as indivual claims, you could of course use it in your argument as part of your argument if it goes to court, but even then its down to the judge on whether he will admit it.

There is always the possibility that they clicked the wrong box by mistake, I think we should hold back celebrations until this happens a few times.

AD, I dont think they will retract from here even if it was done by error, they would have to pay up in a few weeks anyhoo, so they will prob agree to settle regardless.

 

When you phone, make sure you have your updated SOC with all costs etc added , dont accept anything you are not happy with, and amend the agreement to meet YOUR criteria not theirs.

 

Dont agree to stop proceedings until your are in possession of funds

Thanks Mick,

 

Got another "sorry to hear your unhappy" letter today in response to my rejection letter from Leicester.... and they will look into it in the next 8 weeks! different reference numbers to all the other letters, im sure it's just to confuse.

 

Have had no contact from Barclays re settlement so will be off to the court on Friday. Do I tick the pay immediatly box.... im thinking yes?
