Advice needed,

I sent my first letter on the 26th jan to Barcleys London and got a reply back today 1st feb from cheshire.

here it is:

DATA PROTECTION ACT

We refer to your letter of 26 Jan which was passed to this dept for comment due to your request for certain information, relating to bank charges, under the terms of the Data Protection Act ("the DPA").

Please be aware the bank is under no obligation to present information according to any particular format. Therefore your request to assemble a schedule of charges is yurned aside. You may of course obtain this data from copy statements and these will be supplied to you in the next few weeks without charge on this occasion. We would advise however, that statement information prior to 2000 is stored manaully rather than on computer. Therefore if your account was opened prior to this time, there may be an increse in the time required to collate the information you have requested. I apologise in advance should this delay be cause of any inconvenience to you.

As regards to your mention of "manual intervention", the DPA does not oblige the bank to comment about internal policies and procedures. Furthermore, in context of managing day to day transactions arising from out of order accounts, the bank does not hold the information you have requested in a form that would be covered by the DPA. Whilst aggregated information is retained for statistical purposes, this would not constitue "personal data" ubder the DPA and therefore would not be covered by a s.7 DPA subject access request. For avoidance of doubt, the fact we do not generally record information in a way that is caught by provisions by the DPA, is in no way an admisiion that there was no such manual intervention.

As the bank is provivng copy statements on a complimentary basis your payment is returned herewith.

Does the plan remain the same get the statements add my charges then move on ????

Yes it does. list all the charges and put them on a spreadsheet forund in the templates section. once you have totted up the total amount of charges then send the prelim letter asking for that amount back.

Take your time and if unsure just ask. good luck.

Hi AD33 -- good luck with your claim against Barclays.

Just stick with the tried and tested format on this site and you'll soon have the money back, that they shouldn't have taken from you in the first place

Best wishs. jaxads x

jaxads

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

All in all, quite busy at the moment and enjoying every minute of it

am I being stupid??

ok I dont think I can claim account charges!

and all I need to do next is to write the 2nd letter and schedule the charges inc interest 8%? and send it off to Mr Townsend is this correct?:D.

On my copied statements my interest has been charged shall I just add that to the schedule or let the template work it out!?

somebody help............

ok

you can claim back paid referrals , unauthorised overdraft charges etc.

you can't claim the interest charges because they are allowed to charge the interest , also any account fees cannot be claimed.

the interest you claim is either statutory interest when it goes to court at 8% , or the interest they charged you on the penalties which is harder to work out but there are spreadsheets that will do it for you.

hope that's clear (probably as mud lol ).

good luck.
