    • Hi all,   First time I'm doing this post and first time this has ever happened. I have been sent speeding fines before and I have always sent details and either been to speed awareness courses or had points and paid fine. In this instance, I have supposedly been sent a letter to provide driver information for speeding fine, and then again another letter to say not received anything and to provide again this was all apparently in 2018.   I then received a letter this week (which I actually got) saying I need to pay £800 and have 6 points to add on my licence for failing to provide info and failing to come to court date.   I never received anything prior this the last letter which I received this week.   I have been told to make a statutory declaration, in which they said you need to attend court date and say that you never knew of the letter beforehand, which I said yes and then they said if found to be guilty u could face prison sentence and more fines. I was ok with this as I know I haven't received any letters like this prior (until the final one this week)   After reading reviews its quite concerning as some people have mentioned that the court basically look at your case and even though you may not received the letter, its more of a he said, she said scenario, which as mentioned is concerning as if I haven't received any letters prior how could I have given my driver information and that court could basically say, the letters were sent out and that your lieing.   But as mentioned before I have had speeding fines in past and have always sent off information, if I did make an offence   Is anyone able to give me any advice?
    • Reported the issue within days but the dealer flatly refused to speak to me and pretended to be abroad. There is no way he was going to take the car back. The finance company were behind me initially but then suddenly changed tack when they investigated the dealership more closely. The law states that my contact is with the finance company who provided the finance and who paid the dealer at the onset of the agreement. They are jointly liable for any breach in the law but this is academic as a number of prosecutions against the dealer have just resulted in a change of director (just another loophole that is exploited to avoid paying up)   Finance Companies fall under the Financial Services Authority umbrella and it was their Ombudsman who oversaw this complaint.  
    • nope. what are you trying to do? if its to do with your PAP letter thread you don't need to worry about reclaim just proof the bal is all charges/int   dx    
    • Sorry if I have not understand but I have gone back to post 3 and all I see is list of questions which I have answered in the post after.   Do you mean that I do not need to pay any charge?   I guess mine was notice to keeper without photographic evidence and without the mention of Schedule 4 of the Protection of Freedoms Act 2012    The notice also stats that I should not ignore it or else they can contact dvla to pursue payment.
    • you mean the FOS surely?   did you report the fault within 30 days of purchase to the retailer? if so as andy says you are entitled to reject the car and get a full refund from the RETAILER. under your short term right to reject CRA cannot normally be against the finance co.

      Don't touch them owe me £500 since January 2019 make excuse after excuse. Seem they always have software problems sending money out. Keep saying they will call back or email nothing been chasing it now for 6 mths the phone staff always have the same banter we will chase it up and get back to you then nothing!

    • This is a bit of a lengthy one but I’ll summerise best as possible.
       
      THIS IS HOW THE PHONECALL WENT 
       
      I was contacted by future comms by phone, they stated that they could beat any phone contract I have , (I am a limited company but just myself that needs a business phone and I am the only worker) 
      I told future comms my deal, £110 per month with a phone and a virtual landline, they confirmed that they could beat that, £90 per month with a phone , virtual landline  they also confirmed they would pay Vodafone (previous provider) the termination fee. As I am in business, naturally I was open to making a deal. So we proceeded. 
      Future comms then revealed that the contract would be with PLAN.COM and the airtime would be provided by 02, I instantly told them that this would break the deal as I have poor 02 signal in the house where I live as my partner is on 02 and constantly complaining about bad signal
      the salesman assured me he would send a signal booster box out with the phone so I would have perfect signal.
      so far so good.....
      i then explained this is the only mobile phone I use for business and pleasure, so therefore I didn’t want any disconnection time in the slightest between the switchover from Vodafone to 02
      the salesman then confirmed that the existing phone would only be disconnected once the new phone was switched on.
      so far so good....

How We Can All Help Eachother..

A few weeks ago I was approached by the B.A.G to give my story so it could be used to highlight what people are going through and for it to be used for media releases etc.

 

I must admit that at first I was a little unsure, what would it entail? Would I be forced into saying things I didn’t want to say? The answer to that is a big fat NO WAY!! :) It’s the best thing I have done so far as I have had a lot of fun in doing it!

 

Basically my story in a nutshell is I am a single mum on benefit who set up a direct debit to pay off my credit card. The card company claimed money a week early so no funds in account, the bank immediately took a massive £35 charge the same day!! That’s when I found out about the B.A.G who have become my best mates! lol They recommended ringing the bank first and asking nicely for my money back, so I did and low and behold was given a 50% refund there and then! After that I followed the "step by step guide" and sent off my first letter, within 7 days the rest of the money was credited back to my account! HOORAY!

 

It was then that I was asked if I would be willing to talk to the media, I must stress that the B.A.G respected my anonimity and told me that NONE of my personal info would be given out, which it wasn’t at any point!

 

Then I had a call from the "You and Yours" programme for BBC Radio 4, and asked to take part in a radio interview! Again at first I was a bit nervous but thought Hey! Why not! Before the interview I had loads of help from the group, who explained what was likely to happen and that I didn’t have to do anything I didn’t want to, again they reminded me that I didn’t have to use any of my personal details.

 

So off I went last Friday to the BBC studio! They even sent a car to pick me up then wait to bring me home afterwards! How special did I feel??? lol As soon as I got there I was made to feel really comfortable (just like a celebrity!!) and got to have a look round the studio's and stuff. I must admit it was a great morning and I thoroughly enjoyed it. The lady that did the interview was great, she did everything she could to make sure I got everything in that I wanted to say, I even decided to let her use my name. The way I looked at it was "Im a real person with a real story so why not let people know that!" That was purely my choice though, at no time did anyone talk me into giving my real details out. So, there it is, within the space of a few weeks I've got my money back from the bank and had a great morning out being treated like a celebrity! Not bad for someone who knew NOTHING about this a little while ago!!!

Thank you Annmarie so much for agreeing to relate your story .I am glad you enjoyed it .Yes you are right, by getting these stories highlighted we are all helping each other by people hearing about this site so more can reclaim their money and also letting people see just how these charges affect everyone .

 

You and yours programme only contacted annmarie after she had given permission to be contacted by the researcher.

We were very grateful that Annemarie and others agreed to tell their stories to the BBC. It is very important to keep the issue of charges in the media so that others like ourselves can understand what is going on and will have a chance to reclaim their own charges as well

 

It also keeps the pressure up on the banks.

 

As Annemarie found talking to the media is interesting and also very easy thing to do. There is no problem about confidentiality you want it

 

I am certain that other media organisations will be approaching us the stories in the future and it will always be very useful to be able to provide them with contacts from amongst our users.

 

If you think that you have a story to tell them please let us know. We will act between you and the media to make sure that your confidentiality is assured if you want it and that you are contacted in a way that you want to be and on your own terms.

I would be willing to help. I am a single parent, one of my children is severly disabled.Very often I had no access to the disability benefit as it was wiped out by the charges. On 2nd of May the bank charged me £595.14 for the month of April- all spiralled down from previous charges. I have bailiffs coming out of my ears. I do not smoke, do not drink, do not gamble,do not go out, do not buy clothes etc, I work full time, study for a degree part time, care for disabled child and have no respite help whatsoever. On many occassions I was sitting in front of my online banking in tears of frustration.

I think I would be able to compose myself and tell my story if necessary through public media. However, I am sure that I am just one of many many thousands and I am still thinking how can we portray this fact to the media; that there are thousands of us; people who lost health, business, homes, peace- all because of the absurdly greedy practices of our banks. We discussed here before how can we market ourselves better- any new ideas?

Just sent my details in to volunteer. Great site which has given me the encouragement to start chasing these charges. In two days, more than 10 people have asked for the details when I said I was taking action. Hope it helps.


15/6/06 Clydesdale - DAP delivered to branch

23/6/06 - letter received saying they will send statements

14/7/06 - Statements received, calculator ready!

18/7/06 - charges totalled and first prelim letter put through bank's door

12/9/06 lba delivered to bank

26/9/06 - cheque for £371.03 (half) received

If you want your identity hidden we would hide it .Well actually you just don't need to tell us it .We do not put pressure on anyone to tell us more then they want to .If the media was interested in your story then I would speak to you first asking how you wanted to be contacted and reminding you that you do not have to tell them anything you didn't want to

The only thing I would need is a landline contact number to be used strictly by me to contact you .Under no circumstances would I give your number to anyone without first obtaining your permission.

 

The only thing is though that most people in the media would want someone who was willing to be identified, but not all of them.So please do not let that put you off .

 

We need people who are at all stages of claiming so even if you are only just starting still please contact us and help us publicise what is happening to everyone because of these unlawful charges

Happy to reciprocate the help as I have now claimed back on two of my accounts and my partners cheque for her account has just arrived.

 

I even managed to help her without having to refer to this site as the previous "experiences" were so ingrained and I have since convinced two work colleagues to claim one of them is my boss!!! Unsurprisingly they have both won.

 

The bad news is our employers have just gone into administration last Thursday so my partners cheque will help cushion us till the Government pay my statutory notice, redundancy etc which will mean I lose about £1200 now I wonder if I can claim against the government.....????? Looks like it will be employment Tribunal for me.

My husband didn't send details to our bank, just the amount he thought was correct, adding in a amount for interest. The bank has now entered a defense & the court is now awaiting for forms to be returned with a chequue for £100, he uded different templets to the ones on this site I think, he has now made himself ill , so I must make sure I have the correct paperwork to produce in court, also the correct answers for the forms to be returned to the court, can you help me anyone!!! I have looked at his business account too, which I would like to process, but there are charges of Business Focus & service charges plus interest for nearly every month for years also arrangement fee of £50 & £100 per time plus the usual unpaid & unauthorised. They gave him loan after loan sold him numerous pensions etc., knowing very well he was struggling due to a recession in the print industry, we ended up losing our home. I would like to get at least some money back from them. Can anyone give me good advice!! I'm not very computer illiterate so could you please give me clear instructions as to what I should do,

Hi I will try to help untill someone with more experience comes along.

 

first off what I would do is start your own thread, in the section for your bank. the reason for this so you can get the right sort of help from the people who have claimed back their chargers from your Bank.

 

Post your POC so that we can see what you have sent to the court. In relation to the fAQ you have recieved from the court you can find details on what you need to state on it in the libary section. there is a whole host of information on this site to help you so don't worry to much. read and reread the FAQs as you will find all the information you need there, this is really important, also read threads under the section for your particular bank as you will get advice from there as well.

 

With regards claiming back bussiness chargers you must first send of a SAR request with the £10.00 fee, you will find this and any other letters you need in the template section. then calcuate the chargers and interest using a spreedsheet this you will also find in the libary section, then take it from there. don't rush read as much as you can to understand the process and aviod costly mistakes. don;t worry to much as it can all be sorted out but your really do need to be in the right thread. since you have not staed what bank your with i can not tell you where to look but if you go the the CAG site at the beginning you will see the names of all the banks, just click on your one and start your thread. rewrite what your problem is, and include the particulars of claim you have sent to the court on your N1 then members can see what advice you need to sort this out and don't forget the SAR request.

 

I am sorry I have not been to good at helping you but there are a lot of members with a great deal of experience on this site better equipt then me to advice you. but I cannot stress how important it is to start your own thread under the heading of your bank, thats where you will find the anwsers.

bogoff, if you type bussiness account in to the search it comes up with loads of them, i have just checked, . I am sorry I can not point you to the specific ones relating to bussiness chargers as I do not know how to use the link.have you started your own thread for advice, I cannot stress how important this is as members cannot help if they don't know where you have posted, this thread is mainly for media stories etc and not everyone reads it, althrough it;s very interesting.

this is my bank if you tell me what bank is yours I will send you a link to it I hope this helps as I have driven hubbie up the wall showing me how to do it. if you still are having problems I will send a message to one of the site moderaters to help you. had you been on your own link you would have had loads of replys by now but really not mamy people read this one thats why you are stuck with only liitle old me to help you
