      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

OK having successfully collected £4340.00 I am now going to recover my wifes bank charges and the remainder of what was on my account that I calculated from the microfiche statements that cameafter the claim was submitted to the courts. This is a biggy over £7000 so will be going fast track. But before I issue the court summons I put together this letter as I haven't sent anything to them regarding this since October.

FINAL LETTER BEFORE COURT ACTION

 

 

Account Numbers ******** & *******

 

 

Following several letters of correspondence with yourselves regarding the recovery of the unlawful bank charges deducted from the above two accounts and the successful recovery of £4340.59 already through the county courts via case number 6QZ69704, I am requesting that all bank charges from all of my accounts are now returned within the next 14 days.

 

 

As you are no doubt aware, there has been considerable media coverage of the unlawfully deducted bank charges and in particular that the Office of Fair Trading are conducting a full investigation into the matter further backed by the Houses of Parliament. Therefore you may wish to consider this matter carefully. As you can see I have already successfully recovered one set of charges from yourselves and have funded court action against you. I am committed to fund further Fast Track court action in the recovery of the final amount of bank charges and respectfully request you treat this matter with the utmost urgency and seriousness.

 

 

You may notice that part of this claim covers an account from which the successful court action obtained a settlement. However, that particular claim was made using documentation supplied by yourselves which was incomplete at the time. You failed to comply with a Data Protection Subject Access Request in time for the full amount to be claimed and therefore I will be bringing a separate action for these charges and amalgamating them with the other account number.

 

 

 

 

To date, I have not disclosed details of my successful action against you to the press, nor have I complained to the courts on the conduct of your dealings with the claim. Due to the delaying tactics I and many other customers have experienced, the courts are already unhappy with Abbey's conduct and I will disclose all information regarding your conduct of the matter should you choose to conduct yourselves in the same manner as my previous claim to both courts and the FSA.

 

 

To aid you with the settlement of this request I have enclosed all previous correspondence together with schedules of the charges I am reclaiming. The previous correspondence details the laws and reasons I am reclaiming these charges and I would strongly suggest you clarify this with your legal representative Inga Kirkman at your Registered Office in London who was in charge of my successful claim.

 

 

 

 

I calculate in total you have taken £7073.00. I require repayment in full of this money. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus my costs and without further notice. Please note that the interest would amount to a further £1168.00 at todays date and it is therefore in your best interests to settle at the earliest.

well done noobrider on you success, you are taking them on and winning.

 

Could you give me some advice for my own battle? i am a little confused to the wording on the witness statement i need to prepare. I found a example and it says at the bottom:

 

Statement of Truth

I believe the facts stated within this Witness Statement to be true and exhibit Exhibits [your initials 1] comprising of xx pages

 

 

..er not wantng to appear thick but is this my court bundle it refers to completed with a full 94 pages??

Personally I would take that line out. I typed a statement and attached it to a court bundle. The bundle itself had a front page that gave all the page numbers and what each referred to.

OK boys and girls Not been around much as I have been incredibly busy. Got promoted at work and have helped 4 other people recover their charges from their banks. I finally got round to submitting my claim on line and It's gone up a bit. £8800... cost me £250 to submit but I know its worth every penny. Here we go again.....fast track this time...

 

Got no responce from the above letter but then I didn't really expect one.

 

I've been investigating all my finances and it looks like I have a few more claims in the pipeline.

 

Welcome finance...bought a car with the obligatory PPI insurance 5 years ago. The policy is a joint one for me and the wife....the wife doesn't and hasn't worked...so that was mis sold. Couple of grand there I think.

 

Same with a loan 3 years ago...more PPI mis sold.. I'll have some of that thank you.

 

PS. The new bike is running beautifully, the new PC is awesome... The kids all got a PC each and my new house got carpets and loads of nice stuff. Life doesn't get much better than this....I'm debt free paid all my bills and I feel like I haven't a care in the world.

into it :rolleyes:

Timeline update, received the letter from the court confirming that Abbey have acknowledged and intend to defend in full. They now have until 11th may to submit their defence...oh well lets go and find something interesting to do for a bit then.

thanks lula, do i need to update my spread sheet weekly as the intrest is going up daily also should i claim back the money for ink and time etc for getting my court bundle together.

 

I have not notified court that abbey paid £275.00 into my account as a goodwill gesture back in March (yes i did write back saying no i did not accept it)

They must have been busy changing names on the templates that they have for thir defence! At least six of us have received the same defence this week!

 

Mine was signed by Willem Basson - Paralegal, (good job he typed his name' I'd never have guessed what it was from the signature!

well I thought I would ring my local court to see what was happening as I would have expected to have heard something from them by now. After a bit of a run around I finally had to speak to Northampton. Apparently they have been especially busy lately and had to employ some extra overtime especially over the weekend so I should hear something this week.

 

Looking forward to what course of action my local court will impose.

OK, today received the Notice of Transfer of Proceedings together with an order from the Northampton judge stating:

 

Between Noobrider and Abbey

 

without hearing

IT IS ORDERED THAT:-

 

1. The filing of an allocation questionaire be dispensed with in this case unless the district judge at the court of transfer orders otherwise.**

 

Note: Any party affected by this order may under rule 3.3 (5) apply to have it set aside, varied or stayed. Such a party must apply under rule 23.3 within 14 days of service of this order.

 

** Please note that an allocation fee may be payable in this instance. Please contact the court of transfer for further details.

I will now be writing to the court asking for the defence to be struck out as per the new strategy.
