    • Perfect, thanks Dave.   You're right, a whole dodo storm this has been. As sons of first-generation immigrant parents, whenever something like this happens the old man panics. There was a whole "appeal this now" because my dad paid for the parking as he was with the hirer at the time and he isn't as tech-savvy as my brother so he ended up doing what he did and because I don't live there anymore it came all the way down to this.  But yes, we'll do this SAR and see what comes of it.  Will keep posting here with the hopes that it may benefit someone in the future.  Thanks again, everyone.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, great site. Many thanks to everyone who's actions and threads have led me to taking on the mite of Lloyds !

 

For the last year or two my account has been relatively stable, no real OD and only a few charges. However 5 years ago I was totally skint, bringing up a young baby on a low wage with a mortgage etc. Just like most other people I'm sure. This was when Lloyds were taking up to £150 per month from me illegally. Now its pay back. Today I've sent my prelim letter requesting just over £3k to be returned. If it gets to court and I add the interest it comes in at just under £4k. Can't wait to spend it ! YAY.

I sent the prelim letter last Friday (26th Jan) so I thought I'd check at RoyalMail.co.uk that it had been signed for. However they are unable to confirm delivery. I phoned thed post office helpline and they advised me to check back next week. Aside from the fact that Royal Mail are rubbish, should I still proceed to LBA this time next week ?

you can not proceed to your LBA unless you can confirm that Lloyds tsb have recived your letter. all my letters i sent to Lloyds registerd address have been lost. you have to wait 14-16 days in royal mails eyes before the letter is deemed lost. if you send it to their lloyds andover adddress its more likly to arrive. well it worked for me.

Spoke to Royal Mail today who still cannot prove that they delivered it ! However when I got home this evening my standard response from Lloyds was waiting for me. They even spelt my name wrong !

 

So on to LBA stage tomorrow AM. Game on.

LBA sent this lunchtime. Went for Special Delivery this time to be sure !

 

I intend to pre-prepare the court material so I'm ready to go in a fortnight. Is there any guidance on whether its best to go for MCOL or to submit the claim in person at my local court (Chester) ? Any advice appreciated.

The N1 allows you to be much more thorough in your Particulars of Claim. You can also include your schedule of charges which you can't do with MCOL. Submitting the N1 form - providing you do it correctly - guards against the "Claim too vague" defence that the bank can bring up. Definitely the best option in my opinion.

Just completing my N1 ready to hand in on Wednesday. Please could someone help me with this paragraph

 

Plus interest pursuant to S.69 County Courts Act 1984 from date of issue to date of judgement/settlement at £xx.xx per day {(enter daily rate here - (CHARGES+OD interest)x 0.00022 = pence per day) }OR at such rate and for such periods as the court deems just.

 

What is my daily rate ? What should this bit read ?

Hi Abe,

 

You take the total charges and total overdraft interest (if you are reclaiming it), add them together and mulitply the total by 0.00022. The result will be your daily rate. So as an example:

 

Total charges = £50

Total overdraft interest = £50

TOTAL = £10

 

£100 x 0.00022 = £0.02

 

So £0.02 is the daily rate you put on your claim form.

N1 filed in person at Chester County Court this lunchtime. :D Forgot to attach the schedule of charges to one of the copies (was on the other two though) should this worry me or will the court just give me that copy ? Also, I don't have the original statements as I used the online banking to work out the charges. I included these in my schedule of charges. Will I need the original statements in order to proceed with the court bundle ?

As far as I know internet copies are fine.

Maybe ring the Court about your schedule, can't see it being a problem though.

Bit keen preparing your bundle, anyway if you do, then do not bother to photocopy as it is likely to change.

Usually you would get your £750 by now, latest I have sent is about 2 weeks after filing the claim. Lloyds can be a bit random sometimes you get nothing.

Thanks GuidoT. I'll hold off for a little while then til I know whats what. On a different note, the OFT are due to make a ruling in the coming weeks about these charges. Is it conceivable that I'll miss out on getting my money back if they rule that the charges are ok ?

They will not rule they are okay, they have not done so with credit cards charges, so they will not do so with bank charges.

 

What concerns me a little, is if they then set a charge that is reasonable (not that they did so with cc's conclusively). At the moment we are in the best position in that we get back all the money - after a bit of a fight.

 

The OFT report, like so many of these documents will probably make little difference.
