Hi all,

 

I am helping a friend to try and win back his charges from Halifax. He has all his statements so that is handy when doing his spread sheet but he says they only say "charged as per statement" and unlike my charges which said what the charge was for ie Unpaid Cheque etc. Could someone who if fighting Halifax please confirm that the info i will be using is correct?

ie. date - charge desp. = as per statement = amount

 

Also at what stage do Halifax refund your charges, Nationwide paid me at the Moneyclaim stage but Barclays are making me set a date in court, just wandered how far Halifax are taking there customers and do they close your account once they have refunded.

HIya Prince.

 

What most people on here have on their statement is charged as notified.

Just put whatever the statement says, halifax dont break it down as far as i know.

 

Also they have been paying out at all different times. Some people get it just after lba, and others have gone as far as setting a court date.

They seem to be leaving the accounts alone.

Only really closing them if multiple claims against the 1 account.

 

Dont know if thats the same with most banks or just halifax.

Hi all,

Just a quick update. My friend has received letter today (after sending his LBA) offering him £470 when his claim is for £720. He wants to go for the rest so i guess its off to moneyclaim online now. Does he have to notify Halifax about going to court as i beleive there is a letter about refusing settlement, just cant find it. Can he just proceed to court without contacting them?????

Hi Mark

 

I telephoned them when the LBA deadline had expired, as I didn't really want to go down the court route. They agreed to return the full amount to me on the phone. I did get a bit of a lecture about the cost of running my account, etc. I had the response ready that the interest they'd made alone from the charges on my account would more than cover any costs associated in running the account :p

 

The offer was upped from £1445 to what I was claiming of £2281. The funds were in my account shortly after that.

 

Of course, by going down the court route you can then claim the "little xtra" 8% from good old Howard Halifax!!!

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

Hi all,

 

What should i do? Halifax have written and raised there settlement figure to the full amount but this was after the deadline which they were given. My friend has not yet started the MCOL but should he or can still claim the interest by going down the MCOL and tell halifax there offer was to late now he wants the costs and interest??

 

Or do you think it would be best to take the full settlement and close the claim???

You are not entitled to statutory interest until you file the claim at court.

 

If they have made you a full offer you really must accept it.

Hi - In my opinion I think you would be wise to accept full settlement now. If you were to pursue the claim via the courts purely for the interest element, that is not looked upon favourably!!!

 

Also, the court would see that the date of the claim forms were after the date of the letter of settlement.
