Got a letter from the ICO today and it says theyre going to visit SCAbbey HQ to see for themselves the microfiche system, i think this is in the early part of september.:cool:

On the 4 July 2006 I paid Abbey £10 for Subject Data Access, and am led to believe that a 40 day waiting period is allowed under current UK legislation, 40 days has now passed. I therefore request the following:

  • Information held on me, which you accessed incidentally, in my presence, relating to a previous account which is now closed.
  • This information is available on computer; you are reminded that there are penalties under UK law for the refusal to supply information when requested under Subject data Access and the data protection act.

3. All other information held by Abbey in relation to me within the last 6 years.

If this information, is not forthcoming within 7 days I will take immediate action in the county court using the Data protection act legislation.

Just been on phone to abbey ,reg compliance, they are trying to say my account was closed over 6 years ago??, however i informed them that i know there is information held on me on their computer database, as i saw it in the branch, all of a sudden this info is on its way.. we'll see8-)

Well got my microfiche ?? stements today, intend to contact abbey with lba and complaint to ico regarding 40 day limit.

i hassled abbey and my statements came today, i thought it was quite amusing, when i read that the debt collectors had came to my house, and i had "allegedly said i will set the dogs on you". seriously though its quite frightening what these companies write about you.

 

I sent off for my data on 4-08-06. they finally turned up when i threatened abbey with action via the ico.

I recieved an (allocation) letter from the court which i returned, i presume i will now receive a letter giving me a court date, my question is? has anyone actually gone to court against Abbey yet?.:?

I have a court allocation hearing in the first week of feb 2007.

Question: Will i need to take all the court bundle with me, or what documents will i take to court? help.:?:

I would advise that you prepare your complete court bundle. It's not necessarily required but it helps to be totally prepared for any questions that arise. Is your claim more likely to be small claims?
