hi all,

I have sent a letter to my local branch and one letter to head office about my charges and have totaled to over £1000 in the past year. and i believe that there is more chages so have now also sent one letter to local branch for my full account statements over the past 6 years.

 

Recieved reply letter on 04-05-06 from the first letter i sent requesting charges to be refunded. which says thank you for your letter corncerning charges on your halifax account i have forward you letter onto our customer relations team who will contact you in due course.?

 

anyone help me with what to do next

Revieved leter from halifax Plc customer relations in leeds. this is what it says.

Thank you for your recent letter, i tried to call to discuss your complaint but you wern't avalible to take my call.

 

I am sure you will appreciate that like other organisations we incur costs for every transaction made. When we pay an item against an unauthorised overdraft or return an item unpaid, we incur extra costs regardless of the shortfall involed. we believe it is fair to pass these costs onto the accounts affected, rather than absorb them into other areas of our operations. penalisiing all our other customers as a result.

 

We clearly outline our charging policy in the terms and conditions that apply to your account. In addition, we are committed to complying with the banking code, which sets standards of good banking practise for banks and building societies to follow when dealing with personal customers. the terms and conditions of your account state that you must have funds in your account to cover transactions. We cannot be responsible if you have authorised payments against funds that were not avalible.

 

We are keen to help you avoid any unnecessary charges by providing various ways to keep track of you account. You can do this via telephone banking on 08457 203040, online at www.halifax.co.uk or minio statements at cash machines. you can also contact one of our banking advisors at any of our branches.

 

Ultimately is is you responsiblity to manage your account. However, as a gesture of goodwill iam prepared to refund £170 of charges in full and final statement of your complaint. I must stree that future valid charges will still stand and we reserve the right to close your account if you do not manage it correctly. If you are prepared to accept my offer, please sign and return the enclosed acceptance form in the pre paid envelope.

 

Please find a encolsed copy of our leaflet explaining our complaints procedures. should any of your concerns remain unresolved please let me knowwhat you'd like me to do to put matters right. we are keen to resolve your concerns, if we are unable to do so we'll provide you with details of how you can contact the Financial ombudsman service for help. if i don't hear from you in the next eight weeks i will assume you are happy.

Just a standard reply. I would reply saying that you would only be prepared to accept the £170 as an interim offer - and intend to continue with your claim for a full refund of all charges levied over the last 6 years.

hi,

i have replyed today to the offer recieved yesterday saying that i will only accept this as a interim offer and still wish to claim for full charges made on my account. how long do they have to reply now ?

Im still awaiting on 6 year statements, and cheque hasn't cleared yet they got till the 12 June to send statements.

As you are waiting for the DPA information anyway, I would perhaps give them a week, or so, and see how they deal with your letter. Whilst you could put in an estimated Letter Before Action, it would be a great deal easier if you could go in with a definate figure.

yeh i am still awaiting for DPA info. Thats what i thought to do i will wait and see what there response it to the letter sent today as i am still awaiting DPA. i would of thought that the offer we be much higher than first offer as they still know that i don't know the correct amount that i will be claiming for and try to get me to accept a reduced refund.

Update

 

Hi All

 

as u know i sent DPA on the 3rd May 2006 and still haven't recived the statements so i thought i would telephone them and ask if they recieved my DPA request and they say they never recieved it.and cheque that was sent with the letter was never cashed.So i asked the person on the phone that i want my statements for the last 6 years and she charged me £5 per account which is fair as it stakes they can charge me £10, so then i find out the have charged me twice for one account and once for another totaling £15 which now has sent me over my limit by 45p i hope i do not recieve a bank charge for this. And this will take 3-5 working days to be delievered.

 

My refuse to accept £170 as a final settlment was sent via recorded delievery as i know some of my charges add up to £1000 +. If i do not recieve full refund what is the next step. anyone help please thank you

 

FULL REFUND NOTHING ELSE ACCEPTED

Update,

 

Recieved another offer of £501 for full and final settlement i haven't recieved statements yet. should arrive soon and the letter goes on about closing account and they occur charges all that crap.

after recieving all statements would do i do next ???

I have requested Statements for 6 years worth as I only have statements only which cover aprox 1 year this totals to 33 charges at a cost to me of £1032 I believe these charges are unlawful.

The next letter you receive will be the total Cost of charges I have received over 6 years. I will then request full refund. Then if the matter still cannot be resolved I will pursue for court action.

I understand you have the right to close my account, if you see this as the appropriate action then please do.

I cannot believe the way customers are treated after banking with you for many of years this way it is totally wrong and will take what ever action it takes to resolve this.

I have just worked it out had a dump moment. And Total comes to £1,268,81 with interest. Ok i am all ready to send LBA do i have to send the document i worked out my interest on ?its so exciting lol will be making payment to Website very soon.

Hi Claimers

Ok LBA was sent requesting £1,268.81 last week . Received Letter saying: they offered 6 months of charges to be refunded which I refused and they are not prepared to refund all of my charges. Also received list of all charges which total to more than I am claiming for so now it totals £1373.00 do I sent another LBA ? for this amount ? or do I goto money claim after 14 days ?

Thanks for the advice so it now works out that i will be claiming for a total of £1373.00 without interest and with interest it is £1468.35.

 

After recieving all my statements, they sent me another letter saing they are not prepared to offer full refund and listed my charges for my for free ? didn't really understand as i payed for my statements anyway. and now today i recieve another lot of statements the same ones. as i foned the up to see if the recieved my cheque and they said no and could order them over the fone so i didn't couple days later the cheque was taken out so i got my statements twice and paid £20 for 2 lots and only wanted one lot.

 

Halifax are not going to treat me in this way. i also sent letter saying close my accounts if you wish i don't really care if they close them lol as im opening a basic bank account with barclays.

 

FULL REFUND NOTHING ELSE WILL DO

Hi - I have sent my DPA request and Halifax returned my 6 years worth of statements, which I have looked through and calculated that they owe me £975.61 (inclusive of interest).

 

I sent the LBA letter requesting repayment of these charges and I have had a reply back with what I would think is the standard bull about the incur costs for transaction made and that it is fair to pass costs onto th accounts affected.

 

They aslo talk about their charging policy terms and conditions and the t&c's of the account which state that 'you must have funds in your account to cover your transactions'

 

They have offered me a refund of £90:-( !! as a gesture of goodwill (more like an insult!) and that they reserve the right to charge in the future and close my account if i do not manage it correctly.

 

They have said if amy of my concerns remain unresolved to let them know what I would like them to do to put matters right, can't put on here what I would like to say :-x but is this time to reply with a letter stating I want full settlement or do I just go forward with the standard second letter threatening court action.

Some advice and guidance on structuring an appropriate letter would be appreciated.

I assume you've sent the Prelim, not the LBA??

 

If so, send the LBA but amend it slightly to say you accept their offer as an interim payment only, and will continue to pursue for the full amount.
