      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Im new to this website and have today started the ball rolling with my bank.


In this account i only have my child tax credit paid in and it has on occasions swallowed all of this up.

I have read on another thread about there being some legal reason that they cant do this, can someone shed any light on this please.


I have looked through some of my statements and have so far come up with £1962 of charges and this is not even half of my statements.

What you are looking for is the right of appropriation letter.

You may have to speak to the branch manager or supervisor as not all cashiers will be aware of it. It needs to be sent in 7 days before EACH deposit that you wish to have the use of.

called halifax again today and they stil have not received my request for my statements so i asked to talk to the complaints department as i knew that they had received it.

They offered to email the details so i am waiting for them to come through!!!

great i can now start my spreadsheet. I asked if its ok if i can email my letter and she said that they are 4-8 weeks in dealing with these requests at the moment and i stated that at least then i can start counting the 14 days from the time i submitt then. She then said that if i wanted to just take it to the courts then i should just file now (she wasnt being nasty). I said that i would play it by ear but at the moment the 14 days stuck. Its not my fault that they are taking long.


She gave me the customer complaints direct number if anyone wants it or you can just go through the normal telephone banking its 08457 253519 option 2

Ive Won!!!!!!!!!!!!!!!!!!!

After Just One Email Of The Request Letter I Have Received A Phone Call Offering A Staggering £6,200 A Letter Was Sent Out On Friday And Im Just Waiting For The Postman To Deliver This Now.


My God I Thought I Was Going To Have A Real Struggle On My Hands.

I Dont Know If It Helped That I Emailed My Letters To Carole Reed Or Not But I Cant Complain About The Speed Of My Claim. I Only Sent My Letter Last Thursday And Have Been Told That The Offer Letter Went Out On Friday.


Just Got To Wait For My Money Now


I Will Of Course Make A Hefty Donation When I Have The Funds

We faxed our form on the 28th December and the money was paid in last Friday. I did start to worry and posted something on here - some kind soul gave me a contact name of someone they'd found to be very helpful at Halifax. Let me know if you need it and i'll have a rummage...

I sent my form, and phoned a couple of days later to check that they'd received it when they asked me for details of the account etc - old account that had £8.61 in it which I hadn't realised until I'd had my statements. I told them £8.61 and the person at the end of the line went oh and then I said is it ****.** (which would be £8.61 plus the settlement figure) they said that's right how can we help? To which my response was "You already have!" Thanks very much - so in my case it was literally a couple of days:D
