I thought poor financial management and bad luck had got me into debt. Claiming back my bank charges has shown me that without those bank charges, I would have scrapped through the period of bad luck.

 

I am counting down the 14 days(2nd February) from delivery of claim to Barclays. Doing it was fairly straight forward as we had every single one of those bank statements!

 

I must admit that finding you guys here gave me the courage to do it. I have been talking about sorting this claim for 6 weeks. One day on this site and it's all done! You are all inspirational.

I am still learning how to do this guys.

 

Barclays is on speed, they made me an offer today, I sent my preliminary letter on the 17th!

 

Go people! We will beat them all yet!

 

I am not settling, I was offered £1000, my claim will be over £2,500 with interest.

 

More power to the people!!!!:o

Please find below details of my POC. I would like to submit today. Any advice please?

 

 

The Claimant has an account 60143618 with

the Defendant, opened June 2000 2. Since

05/10/01 the Defendant debited charges and

interest in respect of purported breaches of

contract. 3. Defendant is aware of all

details as a list of charges has already

been supplied. Another copy will be sent. 4.

Claimant contends: (a) The charges exceed

the Defendant's losses caused by the

breaches; (b) The Term permitting the

Defendant to levy such charges is

unenforceable under the Unfair Terms in

Consumer Contracts Regulations 1999, Unfair

Contract Terms Act 1977 and at Common Law.

5. Claimant claims: (a) return of the

amounts debited of 3018.89; (b) Interest per

S.69 County Courts Act 1984 of 8% - £111.84

Alternatively, if the charges are a fee for

Barclays have till Monday to acknowledge my claim. Is anybody near me in the queue? What have they been like since the Indy campaign and their profits hit the headlines?

I'm just ahead of you. My claim was acknowledged on 6th March by Adrian StJohn. Hope everyhting goes smoothly for you.

Barclays acknowledged my claim. I realise that I did not ask for the default removal even though I did in the LBA. Is it too late to amend? The default removal is important to me as the amount of my claim is more than the deafult amount. At what stage can I amend the claim?:mad:

If you are using the MCOL then yes this is common, if you check again tomorrow, you will find they have entered the defence late, no-one knows how they manage to do this but it is quite common.

you will here from the court with details of the defence.

dont worry this will be as std as all other comms from Barclays

Barclays missed the deadline for submitting their defence on Monday. I applied for Default Judgement on Tuesday. The request has been declined today. What do I now??:mad:

 

You should be pleased they have entered a defence. That is what is supposed to happen.

My hearing date is 15th may, i have just called today they are snowed under, they say they will contact me in a few days!! so i would leave it untill about a couple of weeks before hearing date if i was you. they just want to spin it out as long as they can. lovely people??

Hi Matatemi,

 

Well done getting this far, your nearly there now. I rang one week before 'Court Bundle's' were due, and they paid up the following week. Thanks to a tip from Michael Browne. I made my introduction by email and then phoned the following day, in my email I made sure they had an up-to date list of charges. It has been pretty straight forward, I just followed the great advice on this site. It has also been a bit sobering to realise the number of lives that have been blighted by the finance sector preying on our collective ignorance of the laws that govern our relationships with financial institutions. They seem to be living the maxim 'greed is good' to the hilt. Sorry, I am having a glass or three to celibrate the end of letter writing and claim filing with one party. 20 to go!!!!
